Medical retirement - officer less than 10 years

You will absolutely be retired as a captain and if you’re on a promotion list to Major, you will be promoted to Major on your last day of active duty.

If someone is driving their motorcycle to duty and gets in a car crash enroute, can they qualify for CRSC?

That is 100% no. Normally, we say the worst they can say is no, so go ahead and apply. This case would fall under a giant waste of time.

Sorry man. My hopes of this ever passing are about 0%.

    Welcome RetiredColonel-MikeT as a Moderator!

Awesome! He’s a wealth of knowledge.

Signed my 199. Unit still wants to send me to white cell JRTC.

100%. Misguided and insecure commanders do this to send a “message” to the rest of the unit. For some reason they take it personal when someone MEBs - wrongly assuming everyone is faking injuries. I would use any and every avenue available for recourse: IG, Congress, open door policy of the...

Lower DOD % than expected? Affects on CRSC?

That is probably true but not in all cases. It depends on pay grade and years of service. Many of us on the forum receive our residual retirement that is above the 100% VA rate. If my DOD percentage had been reduced to 50 from 70, I would have lost money for the rest of my life.

    Officer Elimination vs. MEB

You’re going to have to stay strong. The process takes FOREVER. I went through it. Your packet has to wait for an adhoc board at the DA level. They will review your completed PEB packet and your full military record. The decision of the board is non-binding though I’ve never heard of a case...

    Bad discharge trying to upgrade

Good on you for getting everything together to submit a full packet. I would caution that awards (short of for valor) are not likely going to have any real effect on your case. These board members are aware that the award system is diluted. When I retired, I looked like a North Korean General...

    Commanders Statement

Exactly. Just worry about what you can control. You’ll be fine - the commander’s statement is a nice to have but not totally necessary. The doctor’s assessments matter more.

    Commanders Statement

You’re confused. The VA doesn’t determine fitness for duty - your branch of service does.

    Officer Elimination/MEB process

You are in the officer “dual process.” An Ad Hoc board at the DA level will determine whether you are admin separated or medically separated/retired. If you can, I’d fight for at least that 30%. The process usually takes at least 6 months once it gets to DA. If your disability could be a...

    TDRL Rating Increase Question

It’s a pretty simple premise that can be summed up with one question: Why on earth would anyone focus on getting better on TDRL in 18 months when it could mean losing upwards of 50 years of benefits?

    Fraudulent enlistment??

    Get an attorney now.

    Fraudulent enlistment??

Not trying to pick on you but for clarification: You went to the ER for a mental health episode and didn’t disclose it when enlisting? Then talk about it openly? Without more info, it sounds like they have a case. I would hire the best possible attorney you can find. The lifetime ROI could be...

    Adverse Action Flag

Just having been in command before, I suspect we’re not getting the whole story. I don’t know one commander that would sign off on that flag. Something is missing here.

    TDRL Rating Increase Question

I am writing my doctoral dissertation on the awful TDRL system and the perverse incentives specifically for combat PTSD retirees.

    CRSC for NTC or training

What are the details of the injury? If you fell running while doing PT then no. If you were hit by an armored vehicle then probably yes.

    CRSC Contradiction

The EPRs could work if they state a specific incident.

    CRSC Contradiction

Just to give you perspective not to invalidate your traumatic experiences: Going now to MH appointments and being specific is unlikely to help your claim. The services want to see documentation from when the incident happened. My educated guess is this is to keep people from “gaming the system.”
