I will take any ratings at this point. I just need to get out of Army Reserves. They are trying to send me on missions. I told them I am pending loss and they said they don't care. My options are go on mission or let them "U" me out of army so I get unsatisfactory. GREAT LEADERS I have.

I believe that there is one on every base and they directly talk to the commanding general for you base and expose corrupt COC. I had to contact mine once and everything changed in my favor within a day.
 
I talked to someone at the retierment office on post and was informed that the office in Virginia was closed for a couple days due to weather, not to mention the closing for system maintenance and you throw in the president day 4 day weekend. Frustration is a understatement.

Everyone tells me don't worrie your close and I hate it. Yeah I'm close but I'm not there yet.
 
Well I just got the call that my DA 199 is in!!! Thats the good news…. The bad news is that because my med board started before I was in the WTU I will have to submit a VARR because they are missing a few of my diagnoses.

Does anyone know if it is ok to do that through your PEBLO??? Or should I try to see the MEB lawyer?

From my experiences within the DoD IDES process, if the IPEB finds you "unfit for duty" then you may do the following via the election of options on the DA Form 199:
  • Concur with the decision.
  • Concur with the decision but request a one-time VA reconsideration request (VARR) of your VA disability ratings for the conditions determined unfitting.
  • Nonconcur with the decision and submit a written rebuttal and/or demand a Formal PEB.
  • Nonconcur with the PEB decision and also request a one-time VARR of your VA ratings for your unfitting conditions.
Albeit, please note that a military service member doesn't give up their legal rights to a Formal PEB by submitting a written rebuttal.

Moreover, in reference to the submittal of a VARR to the DoVA D-RAS for the conditions the PEB determined to be unfitting, the military service member has legal rights to an attorney "to represent me with my request for VA Reconsideration."

As such, the aforementioned quote is annotated on the DA Form 199, Section IX - Soldier's Election under the "Additional election for Soldiers determined unfit under the IDES upon the Soldier's review of the VA disability rating for the conditions determined to be unfitting" section.

With that all said, your PEBLO should inform you of your legal options during the explanations of PEB findings, and whether it's the SMEBC or SPEBC who shall actually assist with the generation of the applicable VARR request if you decide not to demand a Formal PEB hearing.

Of course naturally, if the PEBLO doesn't provide the above information, please ensure to make that inquiry to the PEBLO prior to the completion of Section IX on the DA Form 199.

Yeah i signed mine on the 12th as well, Still Waiting on Transproc!, i dont know what is worse the waiting on the ratings or the simple fact that this whole process is almost over and the wait for this one step feels like its taking forever because i know im so close to the end. The struggle lol.

Posted a few times but here is my timeline.

2/07/2013- Officially started this whole process
3/06/2013- Referral
4/17/2013- VA Claims (TBI,PTSD,Depression,Anxiety)
5/20/2013- Medical exams complete
8/28/2013- MEB complete
8/29/2013- MEB sent to IPEB and VA for ratings
1/24/2014- VA ratings complete (50%DOD/70%VA)


Up until now its been a pretty smooth process. Now I'm waiting on the PEB which now I have ran into some issues

Condradulations how cool. This is the call a lot of us are waiting for. Couple questions when did you signed your 199? Also did they give you your orders or a time frame for your exit? Thanks

I don't think that would be good ideal, because many us on here are well over 154days...
You might piss off the gate keeper who is holding up your case and could make things worse for you.

What date did the PEB request ratings from the VA?

From what I have heard a congressional slowes everything down for you. My VA rep in Seattle told me to spread the word not to do it. I'm at 270 days so you have a while to go. Where ever your packet is they have to stop work on it and find it.
 
Just found out that I hit Transpoc this morning!!!! So hopefully soon I will be out of this place.
