Were your injuries combat related? Did you go through a MEB/PEB with the NG?
 
Thanks for the reply.Greatly appreciated. I have most, if not all, the paperwork ready. Just got a hold of the congressmans office this morning and waiting on a call from them.

My injuries were not sustained in Iraq. It was right after my last tour, Just before my ETS date. NG, I believe, may have done and MEB. It was reccomended on my profile. Not sure though. The fact that my injuries didn't happen while in the NG made it not their issue. Active Duty passed the buck. I have filed DD Form 293 and DD Form 149 a few times each. They passed me back and forth only to tell me to writer the Adjuvant General in Camp Mabry to be put back on orders for an MEB. Some officers took over the case, acquaintances of mine, and they have suggested a Congressional. I just spoke with constituent services and they art as confused as others on the case and suggested I contact the Army Review Board for guidance and try to find a lawyer.

Did you get a DA 199? Go to a PEB? What did your orders state as a reason for separation? Really hard to tell much without knowing what happened.

The NG is wrong if they said "not their issue." I don't know what you mean by Active Duty "passed the buck."

I think you need a lawyer. If you applied to these boards, you should have gotten a response. It is next to impossible to tell what is going on with just general statements. There has to have been a response (unless something is seriously wrong; I don't assume that there is something so wrong- as in they did not respond at all with a substantive decision. However, it is not unheard of for really unusual things to happen). Bottom line, it is very significant as to whether a decision was rendered in your applications before the BCMR or the PDBR. It would be highly unlikely that a decision from these boards would just state "write the TAG and get put back on orders for an MEB." They would have to give a decision granting or denying relief. I am speculating that you either did not get a decision from these boards OR they gave a decision that was adverse and they may have suggested you contact your TAG to seek further relief. Without knowing what actions you actually took and what the actual responses were, it is impossible to give any meaningful insight. Maybe a Congressional could possible help, but, I tend to think that is a long shot. You need to address the boards, or, if they have denied relief, you will have to consider going to court to fight the outcome. However, I can't tell from your post whether you got any decisions from any board. Really need more details to offer any insight. From your posts, it seems you are unclear on what has happened, which makes me think you need legal help.[/QUOTE]
 
update I called the G1 in Austin and talked to the OIC and told him what I needed done he is looking into it. he couldn't believe that I been out 4.5 years and still fighting this mess. he asked me not to file anymore congressional's and that I was in the system with ABCMR and he would call me back. we will see
 
for the ones that are asking me this. my case is being process under the old system not the IDES mine is the "LEGACY"
 
Any update in either case? It looks like I will be fighting the same fight for years to come.
 
Update on my case from ABCMR, I received orders in the mail yesterday, did not get a DD 214. I did get instructions about ID cards, setting up a dfas account with an RSO. I wonder if I will get a new updated DD 214/215??

I was also legacy, not ides.
 
Admin seperation due to non LOD. I wrote the board in 2012, got orders from the army yesterday in the mail. Discharge effective 19 May 2006 at 50% pdrl. E7 19 yrs 16 days (Base Pay) / with 11 yrs 7 months 10 days active (LOS)

All combat related

Dear Q---:

So I imagine that CRSC is now in your future due to combat related findings.

Please keep us in the loop as to your receiving a new/revised DD214/DD215.

And anything else that rolls your way - challenges, wins, another hurdle, etc.

Pleased to read your LOOONG journey in this may be finally coming to a close and that you are finally getting your just and fair outcome (I hope).

For sure. I'm curious as to how DFAS is gonna figure this out, too.

If you have time, would you please post:

1. Your original/old discharge dates, type of discharge, & then your original VA award % & date.

2. Your new updated/awarded military changes and current VA %.

My hope is that if you can post your before/after data, then perhaps someone else who has had a similar experience will assist with how this might shake out for you.

Hopefully, you won't have any "pay-backs" and can apply for CRSC, too.

UPDATE !!!! I have retirement orders !!! they backed dated them to FEB 28, 2010.. all combat related I as rated at 70% by the army.. 100% VA now I'm dealing with RSO trying to fill out a 2656. they are talking about back pay I have no idea how I started drawing 60% VA in Dec 2008 then moving to 100% P&T in 2011. so I don't know how this will work. my PEBLO said that I mite get back from 2010 till now or 2008 to now.. no idea !! my VA is more than my Army retirement pay

ok as of today the DA 2656 starts the my DFAS process for any back payment I have a RSO that doesn't have a clue. Dang I'm so lost I was on the phone today for 3 hours and that's all that I have found out. on 2656 it asked the Amount that I was drawing from the VA at the time of discharge in 2010. I was 60% getting $ 1754.00 a month. I asked about that they told me to read the paperwork at time of discharge. well in 2011 I went to 100% P&T. so I have no idea. the SBP will run me $ 126.00 a month me and my wife talked about that and that's a little high for us. so we turned it down. life insurance policy is cheaper. anyway with having back dated orders I would start out with 6K debt to them.


the question I have is how can they back pay me when I already drawing VA ??? hmmm ABCMR said I was due back payment....... also my RSO told me this process can take 30-90 days to find out anything !! just more BS !!!
