MEB AFTER 3.5 YEARS OF DISCHARGE

I was discharged medically unfit for duty for my (spinal fusion ) I have a LOD on it. it happen in Iraq.. they put me out of the National Guard. I kept asking for a MEB at the time of separation I had a rating of 60 % then it increased to 100% P&T from the VA. I filed a congressional with the Army and now they want to do a MEB. they sent me a letter telling me that I would be placed back on orders in 2 weeks to 2 months. How can they rate me or put me back on orders after 4 years??? I just want the retirement ( Tricare insurance for my family ) also they are talking about back payment... date of discharge from national guard was Feb 28, 2010..
I have a LOD on everything !!!

anyone ever seen this ???

It seems as if you are getting exactly what you asked for. They never did an MEB, and you pushed that fact through a congressional. They are now giving you what you asked for. If you want retirement and all the benefits that go with it, you have to go through MEB. They can't just skip the whole process and retire you.
 
that's what I'm thinking now with the new system that gives you the rating for military and the VA. will this change my rating? they also said something about back pay ?
 
I am in the same boat as you are, PM me I can share my experience. My Meb packet is at Ft Bliss. I was discharged in 06 with retroactive backpay as well.
 
was told today I could see orders in 2 days or 2 months lol !! hurry and wait
 
Yes I've seen this before. I strongly disagree with ordering someone back to a duty status and running an MEB on them if I have a VA rating which was made in close proximity to the date of discharge. There really is no reason for it. But that's what they like to do. And yes, it will be retroactive back to your date of discharge.

Tell them you want AD pay for that day! ha :) How close is the MTF where they will be doing your IDES? Have you been assigned a PEBLO?

ok today was told waiting for the OTSG to call me maybe sometime in JAN 2014 I guess
the ABCMR ruled that I will have a physical.
 
That's what the BCMR normally does when it grants relief in these types of cases.

well I found a contact for the OTSG and made the call they are working on my paperwork. they said the 1ST problem is that. I never got rated at time of discharge that's how I would be rated so they would maybe go off my VA rating paperwork. just keeping everyone up to date on this. this is how we learn.. she said some paperwork was sent to DFAS also I'm thinking that was just BS

well the big day is tomorrow !!! I'm having my MEB at Fort Hood. on my Lower back and PTSD and a few other items ... almost been 4 years...
no idea what will happen already rated 100% P & T with the VA.. everything is combat related so lets see what happens
 
I feel your pain Bro, Mine is coming up on 6 Feb. I am 80%. Mine should go back to May 06. Keep us posted
 
ok I got my PEB back today they rated me at 70% army with 4 years of service. I have no been out of the army for 4 years. all of the injuries are combat related. VA is 100%
