Well my appeal is still sitting with my local office and hasn't made it yet at all toward the BVA. I wonder if that would make a difference?
I think in my opinion you might be ok. The main concern is to get your file from the BVA. If your file is still at your regional office you should be fine.

Would be surprised if you got you 199 at the end of the month. 257 days is total at the VA was 186-188days. Like they say all cases are different.

So i got a question if you know on the unfit memo for DDD of the lumbar spine it has V1-no V3-no V4-yes what does that mean is it good if i have a yes

In June of 2013, I was told by the Houston ROVA that I would have given 100% but because I was not currently under a MEB at that time, they could only rate me at 90% (total BS even though I submitted all the docs showing that another MEB is in the process) and the 2nd MEB didn't start until Sept 2013. I was denied IU at the time because military income exceeded the poverty threshold for IU.

I may not need the appeal if my proposed ratings are interpreted correctly from the VA for the PEB, I have 3 unfit conditions that I hope exceeds or at least 50% mark on the DOD side, and hope 100% from the VA.
The 3 unfit conditions the Narsum states "service member has reached MRDP Medical Retention Determination Point, based on his ability to return to full duty after greater than 12 months of treatment and limited duty due to his conditions of PTSD, Neck DDD C5-C7, RT Ankle.

Also all 3 unfit conditions state, "SM will not return to service in 5 years", So I hoping my outcome will be PDRL and not TDRL.

Indeed, it seems that you have good opportunities for a "permanent and stable" finding for the "Neck DDD C5-C7" and "RT Ankle" medical conditions for sure except for the "PTSD" medical condition unless your medical evidence shows that the condition was "permanent and stable" for a couple of years.

Otherwise as based upon symptomatology of course, the IPEB shall potentially use the 38 CFR 4.129 PTSD criteria (e.g., minimum temporary rating of 50% for at least 6 months). Therefore, an opportunity to issue an overall TDRL adjudication for your DoD IDES case file shall potentially exist at least from my experiences within the DoD IDES MEB/PEB process.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

To an extent, military service members whose disabilities are the direct result of armed combat, combat devices, or combat training (often grouped together under the term “combat related”) are authorized tax exemptions for their disabilities and may be entitled to Federal employment benefits.

From an U.S. Army perspective, upon receipt of the DA Form 199, review of "Section V - Administrative Determinations" shall state as follows dependent upon the military service members particular situation:

1. The disability disposition “is based” or “is not based” on disease or injury incurred in the line of duty in combat with an enemy of the United States and as a direct result of armed conflict or caused by an instrumentality of war and incurred in the line of duty during a period of war (5 USC 8332, 3502, and 6303). (This determination is made for all compensable cases but pertains to potential benefits for disability retirees employed under Federal Civil Service.)

2. Evidence of record reflects the Soldier “was” or “was not” a member or obligated to become a member of an armed force or Reserve thereof, or the NOAA or the USPHS on 24 September 1975.

3. The disability “did” or “did not” result from a combat-related injury under the provisions of 26 USC 104 or 10 USC
10216.

4. The disability severance pay “was” or “was not” awarded for disability incurred in a combat zone or incurred while performing combat-related operations as designated by the Secretary of Defense (10 USC 1212); dependent upon the military service members particular situation.

Moreover, in your particular situation as annotated on the PEB unfit memorandum, the V1, V3 and V4 codes correspond/relate to each aforementioned numbers above as determined by the USAPDA PEB (e.g., 1 = V1 ("is not based"), 3 = V3 ("did not"), and 4 = V4 ("was") in my opinion.

I just checked my ebenefits and it finally changed today from gathering of evidence, where it has been for several months to prep for decision. What has this meant and from what I gathered I may get ratings in a week or 2? I hope so. I also hope that the va fixes the peb incorrect label of a condition epts which is completely false, I will win with rebuttal but hoping that it gets fixed before back to me.

As such, if you don't stand up for yourself for the best DoD IDES outcome, then exactly who will...the PEBLO, MSC, FPEB attorney; hmm, I think not from my experiences in my opinion?

To that extent, fight then continue to fight some more until receipt of desired expectations from the DoD IDES MEB/PEB process are obtained for sure!

So just a question if anyone can help I am at 161 days for ratings and 236 days overall now can anyone maybe give me an idea on how many more days. I am active duty and was found unit 23 Sep 13 1xunfit and 23 VA Claims. I was found unfit dor DDD of the lumbar sprine so that has to be servance pay correct.

Unfortunately, that's pretty difficult to calculate at this point in time!

In reference to your PEB referred unfitting condition, symptomatology from your medical evidence shall potentially determine the disability rating from the DoVA D-RAS.

As such, the DoD must adapt the rating percentage from the DoVA D-RAS in reference to your PEB referred unfitting condition for either a military disability retirement determination or military separation with severance pay determination. Which do you prefer at this point in time?

Hmm, what were your Range of Motion (ROM) measurements for your DDD of the lumbar spine? Do you have any more serious medical complications in addition to the DDD of your lumbar spine condition?

To that extent, there still exist an opportunity to receive a military disability retirement determination if your ROM measurements correspond to a 30% or higher rating from the DoVA D-RAS. Otherwise, a military separation with severance pay determination shall potentially be rendered for a 0%, 10% or 20% rating from the DoVA D-RAS?

Whoa, I was rated at DoD 70% & VA 90%. I haven't sign my 199 yet and don't know if is TDRB or PDRB.

Hmm, it seems that the recent inclement weather (e.g., snow accumulation) closed the U.S. Army military installation yesterday and I was not able to start my official post clearance activities. :(

Indeed, Mother Nature needs to "chill out" with these unforeseen inclement weather patterns until at least I can complete my final important mission as an Active Duty military service member! :eek:

No worries for sure! I shall not be denied; therefore, I shall re-engage today since I have two more days to clear that U.S. Army military installation! ;)

I hope and I have been praying that it is not TDRL outcome.

I also turned in a letter from the VA Psyc. DR. and he wrote "he has been under my care since 2008 for treatment of PTSD, Depression and Anxiety and anticipate that these diagnosis will likely require treatment for an indefinite period of time."

Six years of treatment for BH with a rating at 50%, hopefully this defines there definition of permanent but I'm far from being stable, the last C&P from Oct2013 show signs of increased severity of my mental health problems, it will only get worse if they keep in a TDRL status.
 
My packet was sent to Seattle 21st of Jan, after looking at everyones timelines I'm guestamating ratings April/May timeframe. Does that sound about right? Just had two unfitting PTSD/DDD.
