IDES and VA back pay

VA has my claim as September 7 2011. It's now almost march. I am under ides. Whenever they finally reach a decision will I get back pay from the date the claim was filled?
 
Its my undersdstanding that when you get your military discharge, then the day after is when your VA is retro to for your VA pay. I am assuming you have never had a VA claim in before you hit ther IDES process. If so, you'll be just like me - a VA first-timer. I'm in the IDES process, though almost done and due to discharge. I was told that my VA claim during the IDES process will be verified by the VA (since you get a "proposed" rating while in the IDES process), that those monies will arrive to my bank within a month or two after discharge and be retro to date of discharge.

If you are on active duty, it will be day after ETS.

If you are reservist not on orders, this is an interesting question, I would argue it should backdate to date of claim. They may not get that right though, so, if not, I would submit Notice of Disagreement as to effective date of award. (Though, I think the answer might be different if you have never previously held "Veteran status." That would be pretty rare circumstance for someone going through IDES).
 
The VA Rep that submitted my claim, told me that it was retroactive to the day that the VA received my claim, not to exceed one year, even though I'm still going through the IDES (active duty). There are many others here with me, that have been told the same. How is it that we have so many incompetent people "helping" us through this process?
 
Mpadair, how can it be retro to the date the VA recieved the claim for IDES, technically the VA recieved my claim or started my claim in September 2011. I have always been told it would be at ETS like Jason said. So i am curious how someone told you that it was retroactive to the claim recieved or are you talking about when you turn in your DD214. I was confused by your comment

I am in this exact situation as a reservist that was not put on orders. My proposed rating game to me 30 Sep 2011 and was out effective 26 Dec 2011. I have been getting the runaround from the VA in the sense that I could not get a straight answer on what was taking so long. Come to find out, the VA thought that I was on orders when I was discharged and they were waiting for a DD214 that we don't even receive as reservists. I finally got that straight and it has been yet another month. My eBenefits says that a notification letter has been sent out on 9 Feb and nothing still.

I also was receiving benefits prior to my MEB so I will update and let you know what the outcome as a reservist is for back dating purposes. My first claim was filed 30 Nov 2010 and I was receiving a percentage from the VA prior to that.

Yep...100% correct.
 
The back pay is to the day of discharge if active, and for reservists it is from the day the VA receives your claim. God Bless to all of you on here. I am medically retired as of next monday, and I can not wait. It has been a long road for all of us.
 
But the question is....WHAT is the date that is considered the date the VA receives the claim? With the IDES, it goes thru the VA's hands a few times....the initial C&P exam....then after the PEB finds unfit, the VA gets it again in order to give their rating. Reservists aren't officially filing a claim with the VA, our packet automatically goes thru the channel during this process.

I checked with my old base. If you are a reservist, the day the you filled out the paperwork to be set up for C&P exams with the VA, is the day that they will use for your back pay. Good Luck, this process is very stressful.
 
Thanks kefer82. Eventually they are going to have to create a new condition to be rated for: PTSD caused by the MEB/PEB!!
 
i have a question i am going trough the IDES program.. and i just logged on too ebenfits and i saw an update about my claim status: Preparation for Notification. does that mean the has a % for me on my claims and if so will they mail me a letter saying what my % is. also how would i know about the DOD side. thanks
 
For USMC GEORGE- just curious .... when did you ETS from the military? My ebenfits status is still sitting at pending decision approval, even though the 1800-827-1000 reps have told me im in the final stage.....basically how long has it taken from ETS to you getting that update?
 
I am in the reserve but my contract don't
End until nov 2014. But I have a total of 9 years
