Adjustment Disorder news

Just got back from the IG office. The hold up is due to there being nothing in the regulation that states weather or not CAD meets or fails retention standards, so until they get that put in nothing is going anywhere. They spoke with a LTC Goodwin who stated that the sec def, the surgeon general, and 1 other person have a meeting on Tuesday to discuss the issue, so hopefully sometime late next week there will be more information on what's going to happen or how long it's going to take. I have no idea how long it takes to get something added to a regulation but I can't imagine it's going to be quick...

Curious question about this. I had adjustment disorder as a condition listed and got out on the 14th of May 2013. Is there any word on looking at past cases that have already left the military? I am wondering if this would impact me some how. Thanks

Okay, good news... kinda. The SecDef signed the new guidelines and they "just need to be approved and sent out by MEDCOM." Rumor has it that it could be this or next week. Of course we still don't know what it will look like, or how they're going to clean up the mess made by not thinking it through in the first place.

Well the good news just came thru for me the Congress person I talked to said that my ratings are done except for one item! I am assuming that would be Adjustment disorder.... just waiting on approval for that which we just found out was signed today so things ought to roll pretty decent, at least keep me under 300 days I mean I got a SGT who got his meb started and ratings in 93 days so yea Im a little happy for myself at this point!

MEDCOM doesn't need to approve it, maybe a better term would be "review." I'm with you, the refinement should have been done prior to a SECDEF signature, but then in keeping with tradition, why not make changes of some sort afterwards so addendums can be generated.

I would say it is very unlikely you will get any extra relief from the Army side of the house. The fact they let you separate is all I need to know.
 
Since they just put my info in and if I get pushed through (bc of the congressional) ill let you know

Speaking of moving through any ideas how long it'll take them to approve or whatever they got to do to get that signed off on???

Thank you for that information. I wondered up until the day that I separated. The board looked at it on my 199 and said it would be unfitting but found it fitting because it didn't impact my job. I think in hindsight I should have pursued it further. On the other hand I am glad to be out and able to go to school and move on with my life.

To all who wondered what JMAC8026 brought up about their own case, here is what I can tell you. I had several of my cases show, in the electronic PEB folder, a behind the scenes effort by the PEB to allow some cases to actually separate. They had legal look at them and then apparently apply the presumed new standard to those cases where it was, at least to them, fairly clear that the case would not be changed. This was then administratively handled behind the scenes with no notice to the PEBLO or soldier. I guess the thinking was that the soldier already had the case adjudicated. Right or wrong, this probably saved a lot of people from adjustment disorder purgatory that wouldn't have had any change to their disposition.
 
Or it could have been used to deny disability retirement. Sounds like a due process issue to me.

So, what's the most realistic scenario here? Is this going to get sorted out and done in a few weeks or several months? My 199 is done and ready to go but I can't sign it because of this hold.
 
My 199 is done too, just waiting for this to get fixed so my case can move forward. I don't have words to describe how frustrated I feel at this time.
