Hello,

I have an interesting case because I was demoted to e-4 7 days before retirement. (working on packet for army board of corrections.)
I have 4+ years time in grade active duty equivalent as an e-6.

I am 70% DOD (Gross pay $2114) [combat related 50% + 30% should be 70% CRSC]
90% VA 30SEP21 (80% VA at retirement 15FEB2015) $2293 VA waiver in place in DFAS.
7 years 6 months Active duty equivalent as per final dd214
Total service time was 11 years 10 months
My longevity pay calculation on my PDRL 199 says $1083 (But that was calculated using the basic pay of an e-6)

According to my calculation if they do it based on my current pay it would be:
$3020 Retired base pay (based on gross pay of $2114 medically retired at 70%)
X (7.5 years times 2.5% per year)
18.75 = $566.25 CRSC based on longevity limit.

Please let me know if I am correct or if I missed anything.
I am making the assumption that they will not correct my pay based on my High 3, also if my military board of corrections comes back would they beable to back pay the difference in pay.

DoD 7000.14-R Financial Management Regulation Volume 7B, Chapter 3

2.12 Exception to High-36 Month Retired Pay Computation for Members Retired Following a Disciplinary Reduction in Grade
Members or former members who entered the uniformed services on or after September 8, 1980 will have their retired pay base computed using the high-36 month average, except for the members described as follows, whose retired pay base is based on the final basic pay of the grade prescribed under 10 U.S.C. § 1406, rather than the highest-36 month average of basic pay.
2.12.1. Affected Members. A member or former member subject to the exception in 030212 is one who, by reason of conduct occurring after October 30, 2000:
2.12.1.1. In the case of an enlisted member retired or transferred to the FR/FMCR, is reduced in grade as a result of court-martial sentence, nonjudicial punishment, or an administrative action, unless the member was subsequently promoted to a higher enlisted grade or appointed to a commissioned or warrant grade, in which case see subparagraph 2.12.2.

2. Your disability retired pay: FINAL PAY x 70% = Disability retirement
3. The retired pay will be reduced by the amount of VA comp received. (Appears to leave zero residual)
4. Active-duty equivalent x 2.5% (2% if enrolled in blended retirement) = longevity multiplier
5. FINAL PAY x longevity multiplier = longevity portion of retired pay and a CRSC ceiling
6. Your CRSC will be the lesser (lower amount) of the longevity portion of retired pay OR the amount in the VA comp tables that is shown for the approved CRSC percentage.

If you followed this these instructions, your estimate should be accurate within a few dollars.

I've looked at your case again. Some additional questions follow:

1. Are you trying to determine what your pay will be IF a board of corrections approves an appeal? Ref: (working on packet for army board of corrections.)

2. I infer you are receiving retired pay now. If so, what is the Gross Retired pay on the most recent DFAS RAS (likely for 1-31 December 2022)?

3. What is the active-duty equivalent shown on your retirement orders, 3/4 down first page, as DISABILITY RETIREMENT, followed by years, months, and days.?

Comment: If you are trying to project what you might receive from the results of a board, it would be best to wait for those results. In general, the formulas previously shown would be used. Also, since it involved a demotion, FINAL PAY would be used.

1. No, I already have that calculated but I am not counting chickens before they hatch.

2. Current mypay statement
GROSS PAY$2,114.00
VA WAIVER$2,293.39

3. See attachment. It is not listed on my final orders. But total is 10 years 5 months and 14 days.

I am confused, I am not getting payed my high 3 pay. I am being payed final pay as an e-4 with more than 10 years. I was demoted 7 days before retirement, to e-4 (I served as an E-6 2010-2015) My payments are $2114 which would be 70% of $3020 which would be roughly e-4 pay.
OK, then I misinterpreted your current status.

d. My analysis:
—retired pay is reduced to zero based on VA amount of 2293.39 being an offset
—7.5 active duty equivalent per your info x 2.5% = 18.75% longevity multiplier
—3020 base x 18.75% = 566.35 longevity portion of retired pay which is in agreement with your computation for max CRSC
IF your active duty equivalent is 7.5 years.

Her computations should be simple because she applied as soon as she could after being medically retired so backpay should only be 3 or 4 months.

The DFAS computations for disability retirement and CRSC should be simple in most cases because:
— they have accurate, pertinent source documentation
— they are not computing the CRSC amounts manually.

Just an opinion based on conversations with retired pay personnel, including one manager in the CRSC section last year.

Thanks! Glad to know its automatic. Hopefully my wife should get her back pay in the next couple of months.

Last clerk did not know what she was talking about. Apparently no audit has been done. I have been shuffled to retirement pay 3 different times and not getting who I need.
On hold with VA Retro department and just got hung up on.
I am calling 8883327411 Option 4, 2, 3, 6, then 3. Currently on hold again. :-(

Audit is done by DFAS. There is a special team that does it. My wife called and checked on her retro backpay and they said it was coming along. There are a bunch of checks and balances. She only has 3 months of backpay so its not a huge deal to wait a bit for it. DFAS said to check back in 30 days if she didn't see it come in yet by then.

DFAS calls the department that does CRSC back pay, "VA Retro" and apparently it is not a department that you can call, but it is a system that senior operators can access. Even though it is very slow and both people I spoke to said they might access it 5 or 6 times a year because it is not that common.
They said that my backpay payment is in the que and waiting on approval.
She told me the same thing about calling back in 30 days, she said "if I don't get it paid by June 13th to call back."
Checked mypay today and the monthly CRSC statement posted today, but only shows the monthly amount.
Fingers crossed; I will see 5 figures in my account on the 1st of June.
Will keep you all updated.

01JUN23 Received Monthly CRSC Pay
12JUN23 Spoke to DFAS multiple times and they informed me back pay was just waiting on approval.
13JUN23 DFAS VA Retro Rep started inquiry on back pay. Also advised me to speak to the VA about back pay.
15JUN23 CRSC Backpay statement posted to MYPAY account under CRSC PAY
17JUN23 Received Back Pay in my account.
