When to appeal VA C&P exam report?

Ok so I'm doing an MEB and my va C&P exam is all wrong. My ROM's are no way what I was measured, they have how they listed my scars all wrong and I don't have a handful of conditions listed because I was told that they would find them on the exam and add them.

I also don't like how they wrote up some of my conditions as they differ from my diagnoses from multiple doctors.

I am in the process of a written appeal for the 3947 as the narsum doc and imr doc are stupid. At what point do I fix the va stuff and how? I do not want to get behind the power curve. Thank you

From the interactions with my PEBLO, I was informed that the VA compensable "medically acceptable" conditions are handled by the DoVA upon the complete transition to a military veteran. He stated to ensure that you submit a VA claim for any/all medical conditions which were not included in the initial VA claim form while still on Active Duty for priority processing purposes.

To thatextent, you are doing the exact correct thing by exercising your optional opportunities via the DoD IDES MEB/PEB appeal process. Even if you are unsuccessful in your MEB appeal process, at least your concerns are well known and documented for all to view.

In retrospect, I totally understand your concerns since I experienced similar improperly administered VA C&P Examinations. Reference the DoD IDES MEB/PEB timeline within the signature section of this post for a detailed outline.

Thus, stay the course; remain strong, and possessing well-informed knowledge is truly a powerful equalizer.

Thank you for the reply. So basically I should try to get as much added as I can during the remainder of the time I am on Active Duty? As far as making changes to what they already have I need to wait? One example is the forward flexion of my back. I have a 2 level fusion and 4 surgeries. I can barely bend without pain. I stopped as soon as I felt pain all 3 times and the doc even said yes very limited but the report shows pain at 18degrees and a 60degree rom which is total BS. Then they list my scar for my alsf as my shoulder scar and never mention the 5" scar on my stomach.

I just don't want to be taken advantage of. I have a family to take care of and I spent the last 20yrs taking care of my Uncle Sam. Now it's his turn to return the favor in my eyes.

From my experiences, some of the VA C&P Examination clinicians do not follow the VASRD criteria for ROM measurements which ultimately affect the military service member potential VA disability compensation rating percentage.

Exactly, it's best to pursue all of those actions while you are still on Active Duty. I agree, your 20 years of dedicated service to Uncle Sam resulted in medical conditions which require compensation by the
DoVA. To that extent, I have 24.5 years of dedicated service to Uncle Sam and now I require assistance with my activities of daily living (ADL).

Thus, possessing well-informed knowledge is truly a powerful equalizer.

I have a fusion at the L5-S1 level and I am tring to stay in. My C&P X-rays of my lumbar spine said that I have a fusion at the L4-L3 and the L5-L4 level and that it appears to be unbalenced. I got these results and I am mad, None of my other post surgery exams match the C&P finding. So my question is was the doc drunk or looking at the wrong x-rays? I contacted a IDES lawyer and he told me to submit a statement to be included in the package on both the military side and the VA. At least if I don't get a fit finding I have a reason to appeal. Hope this helps.

Thank you for the reply. I don't know that much about trying to be found fit, but thank you for help on the appeal of the C&P exam. It seems that the VA tends to have their heads buried kinda deep and mess this up frequently.

I have my letters for my COAD that might help you being found fit for duty if youd like to see them? Just let me know.
