I am an Army Reservist who has gone through the MEB and the PEB and am awaiting Retirement Orders. I received my DA 199 mid-February 2026 and had my PEBLO brief me on it. One of the two conditions the board was considering (IDES) was determined to be Service Connected at 70% but the other was not considered to be service connected. I was determined unfit for duty and recommended for the PDRL. I did not concur that the second condition was not duty related but waived my right to a formal board. I was told that the next thing that would happen was the PEBLO would forward my DA 199 would be forwarded and my retirement order would be cut roughly 30 days from the time she turned it in. Then I got a call from the Soldier Counsel office and scheduled for an appointment on 5March2026 with my assigned Counsel. She told me to change the election on the 199 to "concur and waive formal hearing" but put the explanation of the thing I disagreed with in the remarks block the next section down. I did that and forwarded the updated 199 to my PEBLO and two others in her office. I am not fighting anything on the DA 199. I already have a 90% rating through the VA. The one condition that the PEB determined at 70% was already at 50% with the VA but had worsened since that initial determination. My intention, which I had made very clear to both my PEBLO and my Counsel is to just accept the retirement and determination of the PEB and go to the VA for a percentage redetermination after I have my Retirement orders in hand. Then I got a call on 13 March from someone connected with the PEB office in Texas saying they had scheduled me for a formal board in January of 2027!! I wrote an email to my PEBLO and my Counsel with the update asking for direction. My PEBLO called back on 16 March at 5 in the morning that woke me out of a dead sleep. She was saying that this was just how they were doing things since all the Paralegals were downsized and my Counsel would have to write a deferral letter to the Appeal board. I have yet to hear anything back from my Counsel...
Why did they schedule me for a board when I waived it on the 199, and HOW DO I FIX THIS? I don't want to drag this out. I have sent a few emails to my PEBLO, two people in her office, my Counsel, and the group box for the office of soldier counsel. I have a combined total of 31 years Active Duty, Army National Guard and Army Reserve. I can no longer work full time because of my disabilities and have to use a walker any time I'm outside of my house for my safety. My condition is stabilized and not expected to improve materially. It's past time to call it, folks.
