Waiting on VA ratings, little confused

PEB sent memo to VA requesting rating on 7 unfitting conditions.

I am already rated at 80 percent by the VA.

I have a 50 percent rating by the VA for PTSD. The PEB found this condition unfitting. I was able to find out through my doctor that did my NARSUM the VA put down I had Adjustment disorder/depression in my new evaluation. The doctor that wrote my narsum put PTSD anyways, since there were other diagnosis's from prior VA eval, counselor and Line of Duty.

My concern is the VA will give a new rating for my PTSD now to DOD or not give a rating at all. Does anyone out there have any experience with this type of thing????????

Since PTSD was determined to be one of your unfitting conditions by the PEB, in accordance with 38 CFR 4.129, a minimum DoVA rating of 50% shall be assigned by the D-RAS with a re-evaluation in at least 6 months after military separation/retirement. The DoD must adopt the DoVA D-RAS rating for each PEB-referred unfitting condition.

Based upon your current symptomology from PTSD, the DoVA D-RAS rating may increase as based upon your current degree of occupational and social impairment in accordance with the VASRD.

Lastly, the duration for receipt of your IPEB findings inclusive of the DoD and DoVA proposed ratings is undetermined due to the current backlog of DoVA claims. If I recall accurately, some PEB Forum members reported their duration time for receipt of IPEB findings from anywhere between 1 month to 6+ months; I received mine in 73 calendar days.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Good question; hopefully, other PEB Forum members can provide creditable feedback to your inquiry since I too am awaiting for results for the DoVA D-RAS in Seattle, WA.

Seattle is behind roughly 7-8 months for NG. Mine has been there 7 months. I've been fighting all of this for over FOUR years. Just read the regs, IDES memos and sit and be patient. The AD IPEB rulings have been averaging alot less than any RC...mostly 2 weeks to 3 months.
