Wait Time For Providence, RI

The way my PEBLO explained it, the day I requested is my last day in the Navy. The household goods lady told me that there is a 6 week wait for movers right now. And I can't request them until I have orders. I will get orders shortly before I retire. So when I put my HHG shipment order in, I have to wait 6 weeks for them to get it. By that time I will already be retired and not receiving BAH. She said spring/summer is a really busy season and it takes 6 weeks from when you put in the request. So basically, I'm screwed.

Double check what the PEBLO said, because if you have leave you should be authorized to take it after you outprocess your base, at lease that's the way the AF/Army is, in addition you should be authorized an additional 20 days if stateside for house hunting. The only option that comes to mind for me with your HHG's is a pain in the ass, however you can move your stuff to storage and then give a friend a power of attorney to have your HHG's picked up. You might also explain your situation to the household goods lady and see if there is something they can do in your situation, either that or talk to your PEBLO, you can't be the first person that's encountered this, ask her how others have dealt with it. It might just come down to you burning your leave where you're at while waiting for your HHG's to be picked up.

What about a dity move? You can hire local help for packing and loading a u-haul through household goods, and then they will just reimburse for the cost of moving your stuff.

So I have the best PEBLO, she called me yesterday and told me unofficially, (via a phone call from my VA MSC) that I will be getting 50% DOD and 90% VA (My E-Bennies just changed on Monday, IPEB hasnt recieved my ratings back yet). Now I just need the IPEB to hurry up, so I can see it on paper!

Ugggggh......congrats to all who recently received ratings, with myself being found unfit on 24 December I would hope to get mine sometime soon, however I'm still stuck in "gathering of evidence" with "evidence requested is past due development letter sent". I spoke with my VSO yesterday, I was under the impression that the packages were first come first served and he told me that wasn't necessarily the case, which to me is very frustrating, especially considering I had a guy working for me that started his MEB/PEB a month after me and was done and drove out of the state the last week of February. From what the VSO said mine case wasn't even being worked yet. Hopefully I haven't pulled out all my hair by the time it's done, as it sits now it'll be over a year from the time I was notified at the beginning of August 2013 until I'm retired.

I just called my PEBLO as well and received my unofficial ratings of 50% DOD /80% VA! Im actually shocked by the DOD rating but im even more shocked that she said its one IPEB for the whole military! She said it doesnt look like it has even been checked in at the IPEB as being received! VA sent it back on the 3rd so what is the holdup??? Tomorrow makes a week so I hope it's not longer than another week! Now that I know the ratings are done, im ready to go!!! Haha!

My ratings were supposedly sent from VA on the 14th and PEB didn't receive until the 25th. So there were 11 lost days. Don't know where they went. Got ratings on the 7th. So it was just shy of a month for mine. I think it's like 3-4 weeks for most people.

Hello all,

Hope this finds everyone well. I wanted to update my case status and ask several questions to the folks on here concerning my way ahead with what I currently know. My case moved to Pending Decision Approval on 1 April. I spoke with my PEBLO today and he provided me with my preliminary ratings of 20% DOD and 90% VA. He stated that my official ratings should be forwarded to me via his office in 2-3 weeks.

With this said, I had 3 unfitting conditions: Lumbago (DDD, IVDS), bilateral radiculopathy (sciatica), and right ring and little finger paresthesis. I am still not aware of what conditions were found unfit by the board but, I am guessing the lumbago and radiculopathy were found unfit. As for the 20% DOD rating, here is where I find an issue. I believe that the VA rater likely lumped in the lumbago and radiculopathy and rated it as one condition instead of 2 separate conditions. If rated separately, I definitely would have achieved the 30% DOD rating that I am looking for and objectively rate based on my conditions, medical history and evidence in my medical file. So I am definitely going to contest the 20% rating but, here is where I need advice.

I have read at least 4 other similar cases to mine on this forum and all but 1 were initially rated incorrectly like mine likely has, and those individuals requested a FPEB and successfully had the situation rectified. Since my package mailed in January, I have accumulated 12 additional medical documents from various visits to include physical therapy sessions, pain management procedures, and follow ups with my PCM that all further support my unfit conditions that I was sent up for. I will also have a DBQ filled out this Friday for my thoracolumbar conditions by a Navy Ortho friend of mine in order to accurately denote my ROM since my VA C & P examiner was a joke and didn't properly measure my ROM with the proper device during my exam and simply briefly glanced over as I was going through the flex ion/extension portion. He also inaccurately checked boxes having to do with incapaciting episodes, etc. I have definitely been proactive and have continued to work my case accordingly even after mailing of my package. So my questions are as follows:

1) should I request reconsideration of ratings first for my erroneous ROM based on the new exam data I have, or go straight to requesting a FPEB to address the ROM inaccuracies and the lumbar / radiculopathy being lumped in together?

2) anyone on here have similar unfitting conditions and had to deal with the same issue of both conditions being rated as one? If so, what actions did you take to have it corrected and were you successful?

Based on my VA rating of 90%, if I achieve the 30% DOD the monthly pay check will be very similar so, it's not a money issue directly but, more a health insurance issue. My wife is currently dealing with chronic ailments that have come on rather abruptly in the past 4 months. Continuity of care for her is my main concern and tricare through retirement would provide this without breaking the bank while I go through medical school starting next fall. Just like all of us on here, I have definitely served my time and done it with honor, passion, and commitment. After 11 years of active duty service as an infantry, reconnaissance, and special operations officer, multiple deployments to Iraq, Afghanistan, Pakistan, Georgia, and other posts through out the years, I am just looking for the government to take care of me and my family now a little bit, especially because I legitimately rate it based on my case and documentation when analyzed against the rating guidelines. Any and all advice is greatly appreciated regarding my matter and I appreciate all of your service and sacrifices.

I have the most random question ever. It relates to my planning for leave and PTDY. So I had printed out the milpersman concerning PTDY and it states that the member will not be reimbursed for any travel, transportation, or miscellaneous expenses. So my question is this, does this pertain to a dity move? Due to the length of time it takes to cut orders, I won't have time to put in for a regular move (they take 6 weeks to move you from the date of request). So I am going to hire a company to move my stuff. I really would like to be reimbursed for this. If I am on PTDY, will the military reimburse me for that? Or must I be on regular leave? This is a headache.

Welcome to the PEB Forum! :)

Congratulations on the recent notification of your DoD and DoVA proposed ratings! :D

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Welcome to the PEB Forum! :)

Indeed, it saddens me to read about you and your family's current medical situations! :(

In reference to one of your specific questions, it seem to be more advantageous to demand a Formal PEB hearing to address the lumbar radiculopathy issue and any other medical conditions that you feel should be considered "unfit for duty."

To that extent, upon the completion of the FPEB hearing then submit the VARR request for the lumbar radiculopathy issue and any new medical conditions which don't have an associated DoVA proposed rating in my opinion.

Nonetheless, never default acceptance to potential injustice while championing for well-earned and well-deserve military healthcare benefits via military disability retirement! Take care and enjoy life!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

I noticed the other day in ebenefits that if you open up the details of your claim and let the mouse arrow hover over some of the earlier phases it shows dates on when phases started. My current phase is review of evidence and it started on 2/10/14. What does everyones review of evidence phase look like? (since that's pretty much the final case before proposed ratings are done)

Indeed, congratulations on the recent receipt of DoD and DoVA proposed ratings! :D

To that extent, with the DoVA 100% proposed rating, you shall have an opportunity to receive additional VA disability compensation benefits to include State/local disability benefits while receiving all medical healthcare treatment at any VAMC facility.

Hmm, is it your intent to appeal the DoD 20% proposed rating at this point in time? Or, otherwise accept "as is" in order to receive the DoD disability separation with severance pay?

Moreover, was your PEB referred unfitting condition "incurred in a combat zone" after January 28, 2008? If so, then you shall have an opportunity to keep the military disability severance without DoVA recoupment while keeping the DoVA compensation for the medical condition in addition!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Best Wishes!

Hey Warrior,

I was recently awarded DOD 10% and 60% VA. So I get all the bennies. I'm AGR with the Air National Guard and will recieve my retirement from them when I am 60. I also will be retired from my Federal civilian job with 60% the first year and 40% until I reach age 60. I am recieving a severance package in the amount of $136,509. My VA rep said that since I was 60% that I didn't have to pay it back. I also read that if the VA rates you for the same unfitting condition that the severance pay was not taxable. Have you heard of that?
