VA Proposed Ratings

I am at the PEB since November 18 2011 and went to VA on Dec 2011 but in 6 Jan 2012 the VA sent to DES a proposed rating with a 70% PEB and 100% VA. I know this because I called VA to ask for an updated and they told me I had a bunch of papers and to go get this info to the office. I called the PEBLO and She told me I shouldnt got that info but that those percentages can change. It is true or as a read in the new DES they have to give me the same ratings that VA proposed? Please any response to this situation will b very appreciated. Gracias

You should get the same proposed ratings 70% and 100% from your PEBLO but after you sign and confirm it goes back to the PEB and then to PDA which they make the final approval. They can change your rating if they see a reason to do so and will forward it back and you have a chance to accept or appeal it. Mines came back from PDA Jan 25th and no changes I am awaiting orders now. There was also no changes on my ratings from unfit conditions with the VA. I got the same ratings for DES the VA gave me.

Thanks for your answer. I got 40% for degenerative disc disease of the lumbar spine 30% for degenerative disc disease of the cervical spine and 30% for depressive disorder. Those proposed ratings came out on the 6 of Jan and being over 20 days and havent heard nothing from my PEBLO. My case is on DC so I guess they are over booked but I hope they come with the same ratings and sign the 199 as fast as I could.

What kind of diagnosis do you have? AS? I just want to find out maybe you can give some good information because my MEB just started due to ankylosing spondylitis. I also have the degeneration of the lumbar spine and SI. Thanks.

Since the day I knew I was going to b send to MEB I start reading the Regulations and you can get good info if you go to Googles and search for VA ratings and check there for what part of your body is affected. All I have is the % for each condition unfit but here is a lot of members with a lot of knowledge and they will keep you updated

Today I was called from VA asking from who I got my ratings because I shouldnt get them but I have bad memory and forgot who gave them. My Peblo answered my email after a week teling me that havent received the 199 yet and that those will be the official ratings but he was the one that called VA and complained.Does any one knows if I can call direct to the PEB at DC and ask for an update in my case or is not permitted? Thanks

Today called PEB at DC and one of the Analyst gave me an update and said my DA199 is done that I should receive it this week. I hope it happens soon cause Imy BN Cdr just appointed me as the CO and signed for the whole equipment and is a lot of pressure over me. I hope they come with the same % that VA gave me so I dont have to fight it. I will keep you posted.

How do you find out when the VA sends there recommended rating to the PEB? Mine has been at ASPC for the IPEB review and decision since mid Jan, and from EBenefits I know that my VA is pending approval, but my VA liaason is refusing to tell me the proposed rating, and my PEBLO is an Airman who is just filling in until they hire a replacement so she says I won't know until the whole package comes back. I just want to know how worried about finance's I need to be. By my estimate I should be 90-100% but who knows how wrong I am on that. Any help would be greatly appreciated.

You should be able to easily come up with a ball park figure. For retirement, depending on when you came on active duty, it would be approximately your base pay x .7 less deductions for taxes and Survivor Benefit Plan (mine SBP is $500/mo--ouch). For the VA it could depend on your eligbility for CRDP or CRSC. Hope this helps. Too many unknown factors to give you a definitive answer. FOr me with an 80% rating, I get 75% of base pay less deductions, less 40% Voluntary Separation Incentive (VSI) recoupment. Still waiting on VA rating on the old legacy system, but would not get much more that $1,000 extra/mo since under CRDP, I can't be compensated for the same disability condition twice.

Johnson to tell you the thruth I was lucky because the person in VA probably was new and didn't know I could get the ratings and he even printed and gave them to me and when I told my PEBLO I guess he got mad and called to VA and the VA manager called me to ask me who gave the % to me and I didnt rat on the man. I guess you are not supposed to know so the PEB can offer less of what VA rated and see if you accept but if you fight it then they give you the real ratings.

Today I received DA199 with same ratings that I got b4 from VA I signed it and sent it to my PEBLO. Now I have to wait for PDA for orders and PEBLO said will take between 30-45 days and I think those will be the longest days of all but if I got to here I can wait another month. I hope it doesnt take that long but anything can happen.

They really try and low ball you. I don't know that I relized that they were doing that. I've heard of the people who fight and get more, but I have heard the same thing the other way. Aren't we trying to help out veterans. Since when was haggeling like a dirty car salesman an ok thing to do with people who really need help.
