VA one time reconsideration TIMELINE

Hey all,

I received my DA 199, concurred with the percentage from the Army but asked for one time reconsideration from the VA. I did this on the 27th of March, 2013.

Can someone please let me know the time line I should be looking at?
My PEBLO said he sent the paperwork of 3 of the soldiers (one of them is mine) and received the rest of the soldier's paperwork last week.

Your input is highly valuable as I can get ready for the civilian world as everyone is asking me when I get out when I apply for the jobs.

The Army won't delay your separation for a VA appeal. It will proceed with the disability awarded by the VA for your unfitting conditions. If the VA grants your appeal, the Physical Disability Agency will amend your orders and 199 to show the higher percentage of disability upon your request.

Thats what i thought.... but apparently thats not happening here... Even my peblo said i cannot get out without getting the reconsideration result... Its been over a month already
 
the VA recon is part of the IDES system now, even if you only asked for a VA recon on your cat 2-3 conditions, they will review ALL OF THEM. hence the DOD has to wait until after the VA recon to process you out, because their percentages are based off the VA's findings.

Timeline depends on number of conditions and luck of the draw really: 45 days i think is the stated "goal post".
 
I haven't been involved with this since I retired in December 2011, but when I retired it was the PDA's position that DOD could not hold people who were unfit on the ADL (active duty list) waiting for VA to process an appeal of a rating. Congress mandates the number of people on the ADL. So they were processing the case to finality and if the individual was successful in the appeal, would change the rating and provide retroactive benefits.
 
To be honest I'm not sure how it works but i'm interested in finding out as i may be using the one time reconsideration.

Did you have to submit "new evidence" or do you just write something up with counsel for a reconsideration if a rating is lower than what you think the evidence proves?

Can they change all the ratings with VA One Time Reconsideration? Could they lower some and up others etc?

Also I'm not sure i would even want to leave and get out until it came back and all the paperwork was back.

Technically, they could lower a rating, I suppose. However, I think they would need to find some fraud or plain error to do this. I have never seen a rating lowered by the VA during a reconsideration request. Doesn't mean it can't or won't happen. But, it is exceedingly unlikely.

I have 3 unfitting conditions so I understand that aspect.

If there were to a be a rating lower than what I think it should be and it is just a claimed condition is there a process while still on active duty to get those conditiond and ratings reevaluated?

No, you have to submit your appeals for those conditions once you are separated/retired.
 
Ok I want to make sure i get this....

I have 13 conditions....3 of which were determined to be unfitting conditions.

So if i get a rating of 0 instead of 10% on one or more items that are part of the 10 claimed conditions but the unfitting ones are all rated correctly I will have to sign the 199 and process out with the DOD and VA rating for whatever they are and work later after i get out to get those changed?

In my opinion, this is an accurate recap assessment of Jason's feedback. If not, someone shall potentially post an amendment to the aforementioned facts.

Hey all,

I agreed with the DA 199 and asked for VA reconsideration on the 27th of March...
On my AKO ---> Self Service ---> My MEB/PEB , I had a status update on the 10th of May saying PDA Approval/Review.... but haven't received any ratings yet...
Can anybody please tell me what is going to happen next...

I was told that since I agree with the Army ratings.... They cannot lower them as I concurred with Army findings and just asked for VA reconsideration.... Is that true... By the way it was my MEB counsel saying that....

I did a VA one time consideration after my FPEB ageed the VA left off a major disability on my 199. The day after my FPEB the PEB concurred and the packer was in transient to JBLM but currently my packet is nowhere to be found. I have called my PEBLO and the VA and they have no clue. I have been waiting since my JAG sent the one time VA consideration on 03.25.2013. So the "magical 45 days" sure isnt the case with me. No one knows anything and I am just waiting on basically someone to shit or get off the pot. Over 3 months and waiting. Anyone else in this situation?

The packet was to go from FPEB (Arlington, VA) to JBLM to Baltimore, VA (where I did C&P exams) and then back to JBLM and then back to my PEBLO. Has to be some kind of tracking I would think. But no. The answer is always, "stuff like this take time and we are understaffed". Any advice?

I submitted a VARR request via NCRPEB SPEBC to USAPDA PEB then to DoVA D-RAS in Seattle, WA. To date, I am still awaiting confirmation of submission by NCRPEB SPEBC to the USAPDA PEB. I shall follow-up again next week for a status update.

To that extent, I am saddened to hear about your extend wait from the DoVA D-RAS in Baltimore. Hopefully, you shall receive your VARR request results soon.

I think you submitted through your WTB via PEBLO????? Also how are you checking the status of it? Who are you contacting? Do you have a number out in Washington -JBLM VA I can call direct? When I call the VA line, they tell me the usual, "its in the system". Any help would be appreciated.

Sorry, I am still in the military mode of using acronyms, but a brief definition is as follows:

VARR = VA Rating Reconsideration
NCRPEB = National Capital Region PEB
SPEBC = Soldiers' PEB Counsel
USAPDA = United States Army Physical Disability Agency
DoVA D-RAS = Department of Veterans Affairs Disability Rating Activity Site

To that extent, the USAPDA manages the Army's IDES and acts on behalf of the Secretary of the Army. The USAPDA is a Field Operating Agency of Human Resources Command (HRC) and is headquartered in Crystal City, Virginia.

In addition to the USAPDA Headquarters, the Agency has PEBs located in the National Capital Region (NCR); Fort Sam Houston, TX; and Joint Base Lewis Mc-Chord (JBLM), WA. Medical treatment facilities (MTFs) that conduct MEBs are aligned with one of these three PEBs. This alignment determines which PEB will adjudicate a Soldier's IDES case.

With that all said, unfortunately, I never received a response from my request for transfer into a CBWTU via the WTU; therefore, I am still assigned to an Active Duty U.S. Army military organization. My PEBLO is very efficient and proactive while being overloaded with multiple IDES case files.

In reference to my VARR, I contact the NCRPEB SPEBC in Arlington, Virginia for status updates, but my PEBLO will inform me immediately if he receives any official documentation. I don't have any contact information for JBLM, WA but can your JAG at FPEB yield any status updates for your VARR request? That said, my SPEBC stated that she can track the status of the VARR request submitted to the DoVA D-RAS; hopefully, your JAG can too!

Sounds like we are in the same place. Im in the NCRPEB and went to Arlington for my FPEB and the PEB at Walter Reed/Bethesda concurred. I just emailed my JAG who worked my case and sent everything up for a one time VA consideration. It sounds like if she cant help or find out where my packet/199 is, no one can. Thanks for the info.
