VA Evaluation

Good evening everyone,



I’m currently in a situation and would like some guidance. I’m currently active duty in the Marine Corps. About a year ago, I was assaulted by a civilian which caused me to be life flighted and put into ICU for a week. I was diagnosed with a severe traumatic brain injury due to a skull fracture, internal brain bleeding, and losing my memory completely for a few months. I still struggle with memory issues today and well as other TBI symptoms. I was put onto a med board by a well certified neurologist. The med board found me unfit. I recently found out my VA ratings and it’s 80%. I haven’t received the official document but I have received word from my MEBLO. What should I do from this situation? With the IDES system, am I allowed to have the VA ratings looked at again? I’ve been guided by very high up officers on base to appeal anything less than 100% but I’ve read the appeal process takes quite a long time. I wasn’t sure if the med board allows an expedited situation. Thank you everyone for your time and I look forward to the advice.

My PEBLO stated it would add about a month to the process to a VARR (VA Ratings Reconsideration). Check your NARSUM against the DBQ for TBI to get an idea what the VA Rater is looking at when giving you 80%. Did you have anything else get rated?
 
Okay, I will look into that. Yes I have multiple things put onto there. It was a very rough incident. I was diagnosed with non combat PTSD from the event because of the severity. I lost my vision for several months as well. I have been going to the doctor for the past year on average 3-4 weeks which is 100 miles round trip drive for the advanced medical care to try and better myself. It shows in all my documentation that I am struggling hard but I’m disappointed that it’s not seen. I’m on several medications due to my symptoms as well.
 
The thing to accentuate during exams and the VARR are how the residual symptoms effect your day to day life.
 
Not sure exactly which ratings you are unhappy with each condition has a DBQ that the examiner fills out during your exam you can search for them here:

I’m being told from others that the fact that my TBI was as severe as it was and the symptoms are causing me to no longer be able to hold the job that I currently have in the Marine Corps, it should be rated at 100%. I’m far from educated in this stuff so sorry in advance if I’m not wording it correctly.

If that's the case then possibly filing a claim of TDIU would be a better route not everyone that has an unfitting condition and medically retired from service are 100%. Service members are kinda of ignorant on these matters since they are not vets yet. Ask your peblo or link up with a VSO that can better help you out here they are free and file claims on your behalf. Definitely think about an IU claim though.
