VA decision letter coming

Hello posted on here before about migraines. Today I was told by my PEBLO that I will be getting my VA decision letter in the mail in the next few days and the Informal PEB will be done in the 30-60 days. They have me listed as:
Meniere's Disease 60% Not service connected
Migraines 50% Service Connected
Obstructive sleep Apnea Not service connected
TBI 10% Service Connected
Hearing loss right ear Not service connected
Hearing loss left ear 0% Service connected
low back pain (previously denied under DC 5295) Not service connected
Ankle 10% Service Connected
Tinnitus 10% Service Connected
TMD 0% Service Connected

Here is my issue with the items above. Even though I am in the Army National Guard as a Tech I have letters from doctor's and unit that says the Meniere's Disease and Obstructive Sleep Apnea both occur during drill weekends even though my civilian doctors diagnosed me. Do I appeal the VA ratings now when I get the letter in the mail or wait until the PEB portion is done and ask for a Formal PEB. I have also a lot of medical documents from the original denial for my back showing in the years it has gotten worse since then. Please help me figure out what to do.

Indeed, it's sad to read that you are currently experiencing issues while progressing thru the DoD IDES MEB/PEB process.

Nonetheless, if you disagree with any of the decisions whether via the DoD IDES process and/or the DoVA disability claims process then it's probably best to submit the appropriate appeals within each designated process.

In retrospect, are the above medical conditions with military service connection determination previously awarded prior to your referral with acceptance into the DoD IDES MEB/PEB process? :confused:

Yea I agree with warrior664, if there is anything in question then appeal. Don't accept anything without at least trying to appeal if you feel it's not right. They gave me 0% originally for my TBI but 60% for migraines which were caused by the TBI but since they depressed them it was zero for one and 60 for the other. But that's just proposed I have more documentation to submit and ask for reconsideration because I now have a microhemorage due to the TBI. So yes appeal if it is n question

Today I got my DA Form 199 Could you please read the two pages and give advice. Yes I am a dual tech and was diagnosed between drills, but I had vertigo attacks from the Meniere's during drill weekends and annual AT. I was never sent to urgent care or ER, because my infantry unit had its own PA and DOC in it. On page two it says that my back, has no medical basis, even thought the VA never had the documents for the C& P exam. Also my sleep apnea was found during my migraine treatment so should at least be a secondary. Please review documents and help me. I am trying to get in contact with Lawyers serving warrior for help.

I can't help with a ton, but my understanding on Sleep Apnea is that it is very difficult to have that be found unfitting because a CPAP treats almost all of the apnea and a CPAP does not limit your duty locations to a great extent. Your 199 lists it as existing and as diagnosed. It simply isn't unfitting. You should still get a VA percentage for it assuming it meets all of their criteria.
 
I received the ratings from the VA and it states since I am a traditional guard member and didn't have the army give me the sleep study that my Sleep Apnea is not service connected, even though I took it out to the field with me for over a year with a infantry unit. Also my Meniere's disease is not service connected either. If you are in the Air or Army National Guard you need a LOD for any injury. Medical documents from unit and buddy letters will not count as I am learning now. Please spread the word to guard members that any injury doesn't matter how bad needs to have an LOD from unit, don't let them talk you out of getting one or telling you to get more treatment on civilian time.
