us marine with alot of questions! and no one is answering

hi! i am a 27 yr old marine in hawaii. I am currently getting ready for an informal peb. i have achillies tendinitous and plater facitis. i have had 1 surgery and lots of p.t. and stuff like that etc. ( surgery was 2 yrs ago) i have been having pain ever since. ( i have 8 yrs in). I didnt have bad bad pain till i hurt it training for alfgan. they checked me out, said it was pretty bad and referred me to a peb. At first i was upset, but after talking to my 1stsgt and m.o. i think it might be best for me to get out. its hendering my ability to get promoted, i cant pt. i cant deploy, i cant go to the field, it sucks.i acnt even do my job. i dont want to countiune this way because i still have 3 yrs left on this contract, i would like to move on with my life. Whats the chances of being found unfit? If found fit what do i do? please help

What is your current ROM? DOD states in [FONT=&quot]DoDI 1332.38 you must have at least
[/FONT][FONT=&quot]Ankle: Dorsiflexion to 10 degrees, or planter flexion to 10 degrees. But I am not sure what the Nave will go on. I am in the Army and have -18 degrees of dorsiflexion and was found unfit but only give 20% rating so no retirement. I have been trough a FPEB and just filed a disagreement that goes to DC.

Given your limitations, it sounds likely that you will be found unfit. However, the PEBs decision will be strongly impacted by the MEB Report (narrative summary, basically, how the military doctors evaluate your condition) and the Non-Medical Assesment, your chain of command's assessment of your conditions impact on your ability to perform your duties in your grade and MOS.
If found Fit by the IPEB, you should request a Formal PEB. What to do if you are found fit on the FPEB is a bit more complicated. However, as I stated, it sounds like you should be found unfit. What I would focus on is trying to get appropriately rated and to see if you can get to 30% which will qualify you for a medical retirement. Not every case should be rated at 30% or more under the VA Schedule for Rating Disabilities, however, in my experience, Servicemembers are more often rated too low than too high.

As a Marine myself, I can relate to your concern with your career and disability rating. Allow to me to at least provide some answer from experience and good news for you.

1. You already completed your first term contract, regardless of the outcome, you will get a full honorable discharge, no question about that.

2. Obviously the magic number is 30%, but honestly, that title of being retired is really nothing more than just a title for show. You still going to get out with a RE-3P reenlistment code and you're still getting an honorable discharge. If you're worried about getting pay on a monthly basis, the VA will take care of you. When I was in Cali, the VA have a program in which it gets your claims all sorta out even before you offically discharge from the Corps. After you discharged, just supply a copy of your DD-214, and you start getting pay 1st of the month. VA normally rate you a bit higher as compare to PEB.

3. If you decide to ever want to re-enter back into the Marine Corps, that disability retirement list (TDRL) is a pain. I had to wait 18 months just to get a green light to start the process.
 
im really worried after reading thease fourms of being found fit. i see alot of guys being found fit and that really scares me, i really do need to move on im already behind my peers as far as promotion. being on light duty just pushes me away more, plus the way my peers act.

Hey Marine,

All I can say is just hang in there, make sure you don't voice or overly state that you want to be found unfit, that can be taken as a "benefit seeker". I know from experience, even though my migraines were debilitating and my neuro put me up for a MEB/PEB I was still treated as a benfit seeker.

The process is going to take time, and you have no choice but to let it run it's course. Just make sure you follow ALL the doctors orders and keep a good paper trail.

No one on this board can say what the PEB will decide, but your NMA holds alot of weight in their decision.

I sympathize with you Marine, I have been going through this process for over a year and finally got my findings today.

well tomarrow i have my dictation. the doctors are saying some funny stuff, like weight bearing fine...arch fine... but unfit. mt main doc is saying dont worry about it, you are done but i just dont know. my peb board pack is being sent out tomarrow. so wish me luck

Your doctors need to be careful how they word their dictation. Your docs are not the ones who decide fit/unfit and IAW the regulations they are not even suppose to put their opinion of fit/unfit in their dictation, it is the PEB who decides fit/unfit. Remember the dictation/MEB needs to be signed by you, so make sure you go over it really good (thats why they give you the time limit) and if your not happy with something make sure you talk to your PEBLO and doc about it.
