Update on Rating....

An example of not putting stock in your proposed VA rating at this stage would be that the PEB could decide that the VA made an error. In this case, they could send your package back to DRAS for correction. This could potentially change the % either up or down, different from you've been told as of now.

For all: Can anyone confirm that both VA and DOD ratings post in VTA? I know that the VA % does, but not sure about DOD. I seem to recall another thread where someone's PEBLO was able to see both proposed ratings about a week prior to the 199 being created.

Oh okay total understand but it was already sent out. I just waiting for the PEB to receive it. But isee what your saying about wait until I receive my 199. I didn't even know they could see the rating at all. I just asked was my Package on its way back and he said yes and your VA rating is 100%. That's a good question about being able to see the DOD rating? I wonder if that is true. I just so ready to get it over with. So I know what's going on with the rest of my life. I do have a question. Is the DOD rating system the same as the VA. like I know the DOD only rates the conditions the affect your job but do they go by the same rating system? I would also like to know is there anyone else besides your PEBLO who can see the VTA system.

The DOD is required to apply rating percentages as determined by the VA, but you are correct: they will only apply ratings for those conditions which they previously found to be unfit. I'm not sure specifically who else has access to VTA, but I have read that your MSC and/or JAG consel can also see these ratings.

oh okay thank you so much. I just hate not knowing and the people with the answers not giving it to you.

That's the worst part of the process- not knowing, but this site has saved my sanity. We can only control so much, but having a thorough working knowledge goes a long way toward minimizing stress and helping in the preparation for the many potenial outcomes.

That's crazy

Ok my PEBLO emailed me again and said he is still waiting for the PEB to send my findings to them. I thought he was in the PEB Office. I'm confused. Is there a bigger PEB office?

Your PEBLO's office and the PEB are two different places. Your PEBLO should be on your base. The PEB which your case is assigned to could be serveral different locations depending on your service branch and/or geographical location. I believe all Navy/Marine cases are adjudicated at the Washington Navy Yard in DC. For other services, I'm not sure, but there are also PEBs at JBLM and JBSA.

Okay I just got a call that my findings came in. Now I'm confused on what to do. They said my DOD rating is 20% with severance and my VA is 100%. I don't understand how they even rated my DOD for it not to be over 30%. But I now don't know know if I take the severance pay do I still get my VA money monthly. Is it best to decline the severance because I'm hearing horror stories of people not getting their VA money. Please give me some in sight. If I do take the severance I will be getting a lot back but I have three years left on my new contract. Another question is since my rating is 100% VA do I still get all my medical stuff free. Is this still considered 100 percent disabled

I asked you in a previous thread about:

Do you have a copy of your NARSUM?

And asked if you know what issues are listed on it.

That would be helpful to this thread to know....

Do you have a copy of your C&P exams?

I'm concerned "they" are TELLING you that you have a DoD of 20% and a VA of 100%.

But you have yet to receive your appointment with your PEBLO to go over the HARD COPY of your 199.

What issues are listed on your NARSUM?

Do you have copies of your C&Ps?

I want you to be prepared for a possible appeal - IF one is needed - and this option depends so much on the NARSUM & C&Ps, medical evidence, and whatever comes back as the DoD rating on you WRITTEN 199.

I don't want you to see you jumping the gun, or hitting the panic button just yet.

Stay calm and centered and start gathering up your documents and medical evidence.

In many cases, what is said as a percentage and what comes back on the hard copy of the 199 are two different figures.

In the meantime, start getting your documents and evidence together now so you can be prepared to exercise any/all options you may have when your 199 does come through.

Yes I have an appt MY PEBLO was the one who just called to tell me my findings are in and the percents. I have an appt on Monday so yes these are the ratings

Poohbear, out of curiosity, what is your branch of service? In regards to your concerns about your DOD rating, do you know what condition(s) the PEB find to be unfitting?

In my Narsum the Doctor only talked about my main issue only. My C&P were actually really good. Every Single thing says it affects my job. I really just want to know the answers to other questions first before I even think about trying to appeal.

As I understand it, if you accept your findings and receive severance, you will still be entitled to receive VA pay, HOWEVER, it will be offset until your VA pay would equal that of severance [redacted: scottCC's example is more accurate, below]. UNLESS, the unfitting disability occurred in a combat zone or during combat related ops, then you receive severance and will begin receiving VA payments without the offset/deferral.

Also, with 100% VA, there is a type of health care program comparable to retiree status care, however I do not know enough about it to provide details. Someone else will chime in with more specificity on this.

Affecting your job and making you unable or unsafe to do you job are different subjects. Should you decide to appeal, you need to show not that there are limitations, but that the limitations are severe enough.

They will only offset by the amount of the separation disability, so in this case it would be 100% rate for pay with the rate for 20% taken out until severance is recovered.

CHAMPVA is an option at 100%, but its 100% permanent and total. My brief research shows the cost is better than TRICARE, but didn't look into it to closely because you cannot get it if you are on TRICARE, so now idea how good the coverage is.

I'm in the Navy and and no I don't. I have an appt on Monday. and question what does it matter what conditions they find unfit. It looks like the DOD rating system is different. everyone I know getting their findings back in 2015 DOD rating is not above 30 .percent

As I understand it, if you accept your findings and receive severance, you will still be entitled to receive VA pay, HOWEVER, it will be offset until your VA pay would equal that of severance. For example, if your severance was calculated to be $40k and VA monthly payment was $4k, your VA pay would be offset/deferred for 10 months. UNLESS, the unfitting disability occurred in a combat zone or during combat related ops, then you receive severance and will begin receiving VA payments without the offset/deferral.

VA care for females suck! It does in my Region and it's a problem VA-wide.

They either don't have a Doctor to treat you for that specific issue, or you have loooong wait times, or you relocate to an area with long drive times to get even get to the VA for your goat rope.

Having Tricare as a retiree is GREAT! Minimal waiting, large pool of Doctors YOU choose from, no annual reporting to have to file under the Affordable Health Care Act, and you can be seen in your local area. VERY convenient over the VA.

The DOD is required by law to utilize the ratings for your conditions/diagnoses, as determined by the VA. They cannot deviate from this, however they will only apply ratings for conditions to which the PEB found to be unfitting- this is why the percentages between DOD and VA are almost always different.

Do you know how many conditions you were referred for as 'not meeting retention standards' on your NARSUM?

Here's a DFAS calculator - IF your receive a proposed 30% or greater DoD disability.

You can play with the numbers - crunch a few....

http://www.dfas.mil/militarymembers/woundedwarrior/disabledretireest.html

Remember, retirement pay can never go down - it's permanent if placed on PDRL and you get annual COLAs, too.

And you get it for life - through fat times and lean times. For years and years.

I was told to be ready for severance and it was going to be in excess of 120,000.

But I fought and won my retirement.

In my case, I did the math. For me, after taxes, VA off-sets and everything else, I discovered that if I lived 3 1/2 years after I retired, I would be money ahead for every month I lived 3 1/2 years post retirement. For the rest of my life.

And have health care options, too. And Space A travel. And 100% GI Bill. And VA.

I'm 70% PDRL & 100% VA P&T.

For me, it was worth the fight!

Everyone's case and situation is different, so just get paper and pencil and calculator out and make a list of all your Pros and Cons.

Ok I'm still confused on the payback of the severance pay. So they will keep my whole VA pay until the severance is paid back.
