Type 1 Diabetes. FPEB HELP!!!

I am new to the forum and was directed to it by a good friend of mine, Ruptured Duck(MAC). I am a 29 year old SSgt in the Air Force with 5 years in service. In November of 2008 I was diagnosed with Type 1 Diabetes and have been going through the MEB/PEB process ever since. I am insulin dependant ( 4-5 shots daily ) and am on blood pressure and cholesterol meds. Two weeks ago I recieved my informal PEB results. They recomended 20% disability and seperation. I have since appealed their decision and am currently awaiting my formal PEB. Is there any information that i need to know before I go to my formal board? I already know that I have to have limitations to get to the 40% rating. Is there anything else? What kind of limitations do I need to have? When I eventually go to my formal board will there be a doctor that is a specialist on diabetes ( Endocrinologist )? Has anyone been in the same situation, appealed a 20% rating and been successful in obtaining a 40% rating and retirement? Anyone out there with any input PLEASE respond!

I am a Retired Marine and just got rated at 20% after first TDRL re-eval. You need to make sure your Dr makes sure they put in your record that you have to regulate your activity, your Dr must put in writing you "must avoid strenuous occupational and recreational activity to avoid hypoglycemic episodes for your health and safety" I in involved in working on my case and others. Sent you a PM explaining what you need to do. I went through the same situation and came out getting what I should have in the first place: 40% and PDRL.

I will be heading out to Lackland on the 9th of Sept. I have to report in on the 10th by 0830 in the morning. So far everything has been coming by email of course. I will let you know how the process goes after I return. Wish the best for you!!

What kind of limitations do you have?? It's not the case of "the more the better", it's the case of "if you say it's a limitation versus your doctor saying it's a limitation."

The doctor on your board doesn't have to be an Endo, but mine was a flight doc.
 
If the VA is rating it at 40% under the same criteria that the PEBs must use, that clearly shows a problem of the PEBs illegally making the criteria more than the VASRD or courts dictate.

Do you think they are still using DoDI 1332.39 even though NDAA 2008 made them go back to just the VASRD?

They are not using 1332.39. Rather they are using a tougher and undocumented standard for qualifying for regulation of activities.

Jason took over brokenloads case and will now represent him in Tex. BTW- Jason is looking for anyone else who is type 1 and has been screwed over. He's putting together a class action. Please refer anyone you know who has been short changed below 40 to Jason ASAP.

I am an active duty sailor who was diagnosed a Type 1 in April of this year. Since then I've been trying to figure out whats going on and what the Navy will do. So far I have been told nothing other then i'm starting my next 6 months of limdu and that they are going to start the paperwork for the MEB this month to process me out and that I'll recieve 20%. The limdu coordinator told me from day one that it was 20% and that there was no point in fighting it. I know the VA guidelines for Type 1 and the whole "limited physical activity" part. Well I'm an air traffic controller and there is no way i can ever talk to an airplane again due to the diabetes. That sounds pretty limited to me. Please give me any advice you can i would greatly appriciate it.
 
I am sorry to hear about your situation. I know exactly how you feel because i have been there. I am going to my formal physical evaluation board next week to fight for what all type 1 diabetics should get which is 40% and medical retirement. I will let you know how my board goes and give you any information that you need. This forum is a great place to ask any questions that you have and there are alot of great people that are here to help you and support you. Let me know what i can do to help. Don't get discouraged and dont give up!

Do not let them tell you type 1 is 20%. It's 40%. The key is making sure your paper work matches your actual condition. There are some great people here who are much better versed on the subject than I could ever be and they will help you. It's important that you start talking to these people on and off line ASAP!

You need to start reading everything about the MEB/PEB Disability Evaluation System (DES) process right now. Start with the VARSD.

As a side bar, Jason Perry, the administrator of this site who is a DES attorney, is putting together a class action law suit over this very issue. It would be in your best interest to contact him.

I am curous what they won? I am heading to my fpeb soon with an initial rating of 40% for Type-1 and 1st TDRL review they dropped me to 20%. I have been working with several Congressman and Have sent Jason an email with some of that content to get the VASRD changed so it puts a floor on type-1. What is it they won with Broken load? Was this the class action or an individual FPEB case? I have contacted Jason but have not heard back because if I lose my case at FPEB he can use mine to lump into the Class Action.
 
I have to wait for brokenload to comment, if he chooses to do so. I can't comment on client's cases without their permission.

Jason and i went to my FPEB and were able to get what every type 1 diabetic should be rated at in the first place...40% and PDRL. I am greatful to all who helped me in my fight and i will continue to help anyone who is in need of help concerning this issue. The key is documentation. I went to my formal board with a letter from my endocronologist stating that i must avoid strenuous recreational and occupational activities to avoid the possibility of hypoglycemic episodes. He also stated that it was necessary for my health and safety. I also took with me four months of my blood tests to show how hard it is to control my sugar levels, and because my wife could not attend my board she wrote a notarized letter on my behalf explaining how the disease has adversley affected our lives. jbmmac, let me know what i can do to help.

One thing that I would be willing to bet is that the heat probably kicks your butt, I am a Brittle Diabetic, I can't spend 20 minutes in the heat. You will end up w/ neuropathy which happens in the feet and hands, numb and tingleing all the time, you will also suffer from depression, unfortunately you are going to have problems the rest of your life.
