transfer post 9/11 GI BILL question

i was given my unfit and percentage so will be out shortly. i was told by my XO that i can transfer my Post 9/11 to my spouse without the 4 year commitment as long as i ahve had over 6 years active duty. i tried to do the online transfer and it was rejected. now i am being told that i have to have 10 years in to transfer it. I have looked up the instruction Bupersnote 1780 and it does not have anything about medical sep other than if you HAVE transferred it to your spouse and didnt complete the 4 year commitment due to a med sep you do not have to pay it back. the only thing mentioned about 10 years is you children are not able to use it until you have 10 years in but spouse can use it immediately. does anyone have any idea of this? if i cant transfer it im upset but will deal with it however i do not see that in writing.

It is 6 years in + 4 year committment OR 10 years in.

if you have 6 years and then did a 4 year commitment the transfer has to be done at the time of the reenlistment?

Go to SFAC or WTB and someone there can transfer your benefits as long as you have started the MEB process

I went through the same thing when I was retiring and I was told no you cant transfer any because you will not be able to serve out the 4 year commitment required to do so. I called and called but in the end I am glad I couldn't transfer any. I got divorced and now I am going to use my GI Bill because I can't find any work that doesn't require a degree that I can physically do.

As far of what I have seen (NAVY), you have to be active duty to xfer 9/11 and commit 4 more years no matter how long you have already served. I have 18+ yrs in and can not xfer my 9/11 till I extend to my 20 year mark.

i have found the instruction and it doesnt say much about anything for a medical discharge other than if you have xfered and it has been used and you do not complete your 4 year commitment due to a medical discharge you are not obligated to pay it back as you would be with any discharge other than honorable. seems to me their should be something added to the instruction just for medical sep's. if i wasnt being med sep'd i would have over 10 years and i would have no issue xfering it why should i be punished for something the navy has done to me? i have 9 years so its even worse cause im so close.

i'm pretty sure there is a waiver that can be applied for if your meb'd and cant serve the required commitment. i would contact a va rep for information.

If you didn't have a proposed out date it would be easily done. Now you technically do not qualify. A waiver would be the best option but I wouldn't hold my breath on it.

Q13. What is going to be done regarding transferability for Family Members of disabled
Soldiers who are not able to re-enlist for another 4 yrs?
A13. So long as they meet the base requirement, eligible for benefits and have at least six
years in the service, Army will grant an exception to retention policy to allow them to
reenlist for four years. If they are separated for medical reasons prior to completing
the four years, DA, OSD, and VA will consider the term met and benefits will remain
transferred.

As for divorce you can revoke the benefit at any time!
