TDRL

This thread is dedicated to special issues regarding the Temporary Disabled Retired List.

DragonFly,

I've had computer problems and didn't even know that my post about Chinook -was indeed posted:confused:. Miko sounds wonderful! I'll get to that post next...

I wanted to thank you for sharing your story. I know you touch so many people throughout your posts...and with the hearings, etc--with your continued efforts regarding not only your husbands injuries, but helping others get through their situations too---You are helping many get through the tough times. You are a true patriot.

And, about your story---Isn't life funny! I truly believe with all my heart that EVERYTHING happens for a reason as well. Even though at the time things are unfolding, we aren't so sure.....if we open our hearts and minds we learn how to grow and change and accept things and people for what and who they are-unconditionally. I've been through some tough things, and I'm a better person for it. Even now, I know the universe is just kicking me into another direction...we'll see where I end up.

And the laughter; that's the best medicine of all:)!

Thanks so much. Sometimes I get overwhelmed but it's people like you that help me survive! :)

MEB results

Hello all,

I just was given my results from the USAF MEB, and I'm placed on TDRL. I have a military rating of 30%, and an initial VA rating of 30% for major depressive disorder, insomnia, and panic disorder with agoraphobia.

Since the board, I've been diagnosed with PCOS, and have had surgery twice for dermoid cysts. (Ovarian stuff.) This will be evaluated and rated as well...

I thought that it was @ least 50%? Forgive me for not doing the research, and I'm sure this question has been answered many a time...

Thanks.

Hi tmp,
Welcome to the site!

Short answer on both your questions is no and no. If you are reffered to an MEB, they will usually hold you in one spot until you are either found fit, or are out. Being a term of service retiree (hit the 20 year mark) is the goal I would think, as it would allow you to draw your normal retirement and then possibly disability at the same time. Depending how long everything takes with the MEB (my process started from 9 Jan 2008 and I just now had my MEB packet go to the PEB) you might make it to the "safe zone".

How much time do you have exactly? What are you being boarded for? Have you reached "optimum level of medical care" or are there other measures that can be taken to help your medical issues?

maggiemay,

I hope the results were what you wanted! That is one thing that is confusing, they list your rating as what they judge it to be, but on TDRL, you will be paid at a minimum of 50%.

Hope that helps.

ArticMedic68,

Maybe you can reply to my question offline but I wanted to know what do you mean by medication redone? Are you refering to asthma or PTSD meds? I am on TDRL (asthma) and I am looking to go back but I want to avoid the pitfalls.

Sincerely,

Sorry if this has already been answered but I looked through quite a few posts on TDRL and did not see this answered but my question is this.

When you go in for reevaluation for TDRL, are they looking at just the condition that was found "unfitting and unstable" and my other conditions ratings will stay the same or are they looking at all conditions including "unfitting and unstable" and will be re-rating all my conditions all over again?

I have two completely different answers from two different peblos which is not good....

Hi,

I am trying to find out how to get off TDRL. I am Army National Guard. I was mobilized when I went to the board for a back problem. my 214 doesn't say anything about tdrl, but my ngb22 does. I am trying to re-enlist but they say I have to get off of the list first. I have been on the list for 3 years, I had no idea I was on it. No id or benefits. I recieved a severence when I was discharged.

My back has since gotten better and I would really like to get back in and off of this darn list. I have talked to many people in the guard and VA and none seems to know what I need to do to get off the list.

Any help would be greatley appreciated.

OK. Explain this one. I got 30% PDRL , supposed 50. Now, I'm told this is base pay for the first 2.5 years. I LEFT as an E5.

Ok. My first 2.5 years, almost to a T are at E3 pay level.Within a six months window I jumped to E4, then 1 yr later to E5.

So I 'm getting paid supposedly at the E3 level, not the E5 one. This according to DFAS, who can't keep accurate books at all, nor desires to change that fact.

I have 10% from the VA for mental defect condition. (YEAH, right.)
[Really a sham discharge, but ok.] They decided that the originating condition DID NOT merit the type of discharge given.

Can I get severance for all this pain and suffering from the military that caused this sham of a discharge? I'm not re-enlisting just to be shat on again by my supervisors. That was how this whole mess started.

I have a Press relase on CNN ireport under this exact user name.

Now I know, the payout will dry up eventually, as the discharge was a sham. The absolute last thing I need is this pay cutting out as well as unemployment pay BETWEEN employment contracts.

I have already been unemployed for 8 mohths. My student loans are shitting on me because I filed TWICE for disability because of this discharge.I am at least entitled to a permenent forbearance until I have consistant work. The lender REFUSES to give me one, also refuses to send me a bill.

I had to fight tooth and nail for a copy of my inpatient record from NMCP, and only got assistance with the DOD-IG just recently.

How do I fight for what's mine? I'm entitled to something because of being yanked through this BULLSHIT, even if I have to sue for it. My service record were outstanding. If my supervisors held anything back, they SURE as HELL didn't tell me about it. Personal grudges aren't allowed in the service, and implementing one (even if you are a chief [E-7]) entitles you to Captian's Mast or worse. [This from an O-6 or above.]

I mean ya know there are WAY WORSE off people than me out there, and they aren't getting what they are worth either? Sounds like someone needs to override this part of the governement /contractors with a freight train.

Ok, the info here is great but i need a little more. I'm on tdrl at 50%, i only had 17yrs 10 mos. at the time i was placed on tdrl. since then i have have received a rating of 100% from the VA. I get crsc, but i want to know is there any way those of us that didnt make 20 are going to be considered for crdp? it seems like i'm getting shafted.once im on pdrl is there any change in pay or will it still be offset because of VA benefits. i kinda feel like i deserve crdp. thanx

I am not sure if you have seen my previous post. I have recently recieved a letter to return for a re-evaluation to see if my condition is "stable". This is my first time being re-evaluated. I am nervous and am wondering how to prepare for this meeting with the doctor? What do I bring? How do I prepare? I need your help. Send me an e-mail tilldeath_marine@yahoo.com

Also I am 100% from the VA and while waiting from my PEB rating I was diagnosed with Vestibular Hypofunction with vertigo getting treated for it, diagnosed with TBI by the VA(army said i dont have it, but VA tested me they said I do), Major Deppressive Disorder. With all those condition diagnose, these are not included on my original VA rating. But with 100% rating I am not after any money, I am maxed out, do you think
I should still file these claim after my separation date(July 2009)? I would like to know your thoughts!I would greatly appreciate your response.GOD bless you always!

Warrior.OIF

Thank you so much for all your help with fellow veterans and soldiers. I just got my Tdrl rating this week and i have 80% peb and 100% VA. My question is i already have a date on my Reeval, specifically for PTSD 50%. I am clearing next week for my Tdrl, I also have a fed job lined up! Would it affect my reeval if I work f/time, I need to find a job because I have a family with 3 kids. Would they use that against me and would lower my rating for the VA and My PEB. what are your thoughts? I was skeptical to take the Job @ first because they might lower my rating. But i talked to a DAV VSO and AW2 rep, they said go to work, and it will not affect my rating @ all. But from what I have read in the forum, there is a good chance.
I would greatly appreciate your response.. GOD bless!

I was placed on TDRL on 02/16/09 with 100% for Complete Lt shoulder replacement, and was given an additional 10% for pain in Lt Hip (10 years ABN Status). The hip is really hurting so I am starting treatment with a civilian doctor. The Army wanted to do a hip replacement, as does VA now,(I'm 46 y/o) but there are other treatments available before a hip replacement is deemed the only answer. Am I hurting my 100% by seeking other treatments, and now that the RT shoulder is displaying signs of wear, will it be taken into account if its in my medical records.

Physical Disability Board of Review Update

There are a number of considerations here:

First, remember that your maximum military disability rating for payment is 75%.

Your Shoulder is almost certainly being rated at 100% under the temporary criteria:

5051 Shoulder replacement (prosthesis).
Dominant/Non-dominant
Prosthetic replacement of the shoulder joint:
For 1 year following implantation of prosthesis 100 100
With chronic residuals consisting of severe, painful motion
or weakness in the affected extremity 60 50
With intermediate degrees of residual weakness, pain or
limitation of motion, rate by analogy to diagnostic codes
5200 and 5203.
Minimum rating 30 20

So, your eventual rating will not likely be 100%.

There is a similar temp rating for hip replacement.

Seeking additional treatment may impact your rating if it results in improvement of function. But, you have to weigh what the docs are recommending as the necessity of the treatment and if they indicate that refusal is unreasonable (I don't think this would be what they would say given risks, etc., but you have to weigh what they say).

Timing will be a real issue in your case. For example, if your coming up on the end of your 5 year TDRL period and you do not have the replacement, once you are off TDRL, you would not qualify for 100% rating from military (but you would from the VA).

Hope this helped!

Gah. We are still waiting for a decision. I've been so busy that I haven't been able to check in and catch up here. :(

His paperwork was already signed off and forwarded last month...and his first TDRL eval was Dec. 15th.

Oy. Can we move ANY slower? LOL

DragonFly, I've missed you! I was hoping everything was going good, figured you were busy! I hope you hear something soon! ;)
