Tax Free Pay??

Medically retired from Navy on 29 OCT with a combined rating of 100%. I'm over 20yrs so eligible for CRDP. My PEB findings letter says my disability was the direct result of a combat related injury in the line of duty by an instrumentality of war. Under the legacy codes section, the letter shows a combat code of 1.

Does that mean my pay will be tax free?

I am waiting on my final VA ratings letter so I can apply for CRSC, so while I'm asking does anyone know if that will be "automatic" since the PEB put those statements on my findings letter?

CRSC is tax free. Retired pay in not. So once your CRSC is approved you do taxes will be withheld or due. An instrumentality of war injury should be approved.

As luck would have it, I got my official letter from DFAS right after I posted this telling me what my pay would be and how it would be taxed. My DOD pay is tax free! Not sure if it was the 100%, or the combat related finding with the 1 code, but I will take it.

Hello all and thanks for your help in advance.

I'm a National Service Officer trying to determine if one of my clients may be eligible for CRSC, but the signs are pointing both ways. He's 100% P&T and retired at 60% for a non combat condition. He now has a mental health disorder that might be construed to be combat related, that's a maybe. Anyways, the big question is: with his 6 years of service, and already rated at 100% P&T by the VA, could there possibly even be an amount granted by CRSC?

Thank you all again!

It all comes down to if it occurred in the line of duty during combat. Since the mental health issue is new then it wouldn’t have been included in his MEB. Because of that I do not think he would be eligible for CRSC. Perhaps one of the other members would have a better answer. You should also post this as it’s own question to give it separate attention :)
