Yesterday 20140304 i went to my appointment with ALJ for SSDI after been in a waiting area for one hour a guy call my attorney alone he get in a room and after no more than 15 minutes he came with good news he told me you meet the criteria for SSDI and your case have been approved by the ALJ. I don't need to be in front of the ALJ at all. strong evidence i guess My question is what is next ? and how long i need to wait to get any money and benefits.

The Clerk of the Court (as I understand it) is supposed to send your case forward for financial processing by the SSDI dept that does this.

You and/or your attorney will receive an award letter that will break down your award (back pay and monthly benefit) and it will also have on it how much of your award will be paid to your attorney from your award.

My attorney took their full and lawful cut of my SSDI, plus I was also charged a couple hundred more than what SSDI paid as there were a couple of things not covered in the fee schedule.

It took a total of six weeks or so for my payment to get to me from SSDI.

PLEASE make sure you read the SSDI award finding to make sure SSDI has fully credited you with all the years of FICA tax you have paid and that they have your income/taxed income from all your working years correct. If they are missing earned income/FICA-taxed income in any of those years, this will reduce your monthly SSDI award amount.

What state did you file in? How long did it take to get a hearing after being denied your reconsideration? Did you type out something outlining why u could not work an send it to the judge prior to your hearing date?

Ankon how long was your turn around?

i was denied 3 times until i get an appointment for the hearing, the day i became disable under SS rules is 20100719 so i have been waiting since then for the approval . the state that i file is PR and no additional paper or letters required only medical records and my attorney

i receive my notice of award yesterday stating : we found that you became disable under our rules on July 19 , 2010 By law we can pay benefits no earlier than 12 months before the month of filing. since you filed for benefits on August 24, 2012 monthly payments will begin August 2011

Same timeline as me basically, should be 2-3 weeks until you get your "award" letter that states how much you will be getting, when payments will start etc.

In my case, I am 99.9% certain I will have to go down and have dependents added and wait again for that back pay etc. and of course the calculators online come up with different amounts at different times. so I am clueless in that regard.

Oh. If you are awarded back pay on your SSDI, you can get your previous YEARS of IRS tax returns amended so as to minimize any tax liability your may incur with the lump sum back pay being given to you in this year's tax cycle of 2014.

So get thee to a CPA with these new numbers and see if it is to your financial advantage to amend your previous years of IRS tax returns.

Yeah gotta figure out if doing it the "allowed way" where they adjust this years tax liability vs amending is worth it, I get exactly 24 months back pay with 6K of course going to the lawyer. there is a big difference however in regards to the dependants/without dependants, I thought it was automatic, but some say they have to "apply" some say just take marriage license and birth cert in and all is well. I really cannot find a clear cut answer with all the " your spouse and children MAY qualify for benefits and crap. when I use the long SSDI calculator 9downloadable variety) it gives me 1 figure, the online long calculator another and the quick calculator another, they are all within a few hundred of each other, but at the financial threshold we are at, a few hundred makes a bug difference, until the VA starts paying me and if I "win" the 100% early vs a long fight, even though I know I will eventually win, they can draw it out a long time, and if VA caregiver is any trouble etc. I hate being in limbo and now that Im on terminal, its even worse.
