Severance payback question.

So in preparation that I get a severance as opposed to being placed on the TDRL I was wondering if your case does not get founded as combat related do they take the entire VA check to make payments towards the severance pay or is it a percentage? Thank you very much.
 
Mine is twenty percent that is taken to repay my severance. I don't know about others though.

Is that because the Army rated you at 20 percent? That is how the VA rep explained it to me today. Thanks for the info.

So I was reading through some places in here and I found an answer to your question:

The rule is you can't be paid for the same disability twice. If the military gave you severance for it; you can't get paid for the same condition by the VA until the severance is paid back. Most people get separated for the 10 or 20% rating but when they get their overall VA rating its usually much higher so they get money. They only take back for the same conditions they paid severance for that the VA awards a rating for. All other ratings, conditions, whatever are not touched and they are paid to the veteran since they were not awarded severance by the military for those other conditions.

I didn't know how it worked since some lost everything, some lost half. I think this would help you have an idea.

Ok, that is kind how I gathered it from the VA rep. If I get 20% from the army and 90% VA they will only take 20% repayment? That is the conclusion I came to atleast.

After reading on here, and reading that, if you get 20% from the army for missing leg, and the VA gives you 40% for the leg and 50% for PTSD, they will take the 40% until the severance is paid back. This is how I understand it. So it just depends on what percentage you are getting from the VA for the same condition.

This in part is correct, however please note that the Army (or any other branch of service) will rate you the same as the VA, because the VA does the ratings.

It is also important to note that they do not take a certain percentage of your award, but rather the amount that is paid under the VA schedule.

If you are rated at 0%, they take nothing from your severance, because the VA is paying you nothing, 10% they recoup $136.24 per month, 20% they recoup $269.30 per month. This is based on the current payment schedule.

Beginning Dec 1, 2018 this will change as it does every year.
