Yeah I had hope like when you buy a lotto ticket. All the hope but no dice. I know it's near but it's hard to handle.
 
I was sort of in the same boat this time last year with my ratings also!!

Va completed my ratings but contacted the doc that did my CP exam and told her that the VA needed better quality pictures of scars but im guessing since it was Christmas vacation time they just deferred them and sent off my ratings

My timeline is as follows:
Date referred to MEB 4/23/2013
VA claim completed 5/1/2013
C&P exam 5/28/2013
Narsum Completed with 2 appeals 8/8/2013
IPEB unfit status 8/15/2013
Forwarded for rating 8/19/2013
eBenefits status change to pending decision approval 12/16/2013
(my eBenefits status jumped from gathering of evidence on 12/13/2013 (Friday) to pending decision approval in 3 days, which was over the weekend).
As of today 12/17/2013 I have been in the VA rating step 120 Days.

I have two questions that perhaps you guys and girls could help me with.

The first question is that my permanent profile (the one that sent me to the MEB ) has two separate conditions on it. However, my MEB dr thinks it should only be one condition even though she was the one that altered my profile to accommodate for the second condition. Do you think I will be rated on both conditions? I did an IMR and the IMR dr sided with the two conditions.

The second question is more of a military justice issue. So I am taking narcotics for pain and I told my command that. I told them specifically that I don’t believe it is safe for me to pull duty since I do not want to drive a military vehicle under the influence (narcotics). I have a temp profile from a dr saying that me pulling duty is unadvisable.
However, my command still says I have to pull duty and they don’t care.
My question is if the command is going against medical advice and my concerns, if anything happens will I be responsible or my command?

Does pulling duty require you to drive? Or does it entail manning a staff duty/CQ desk or motorpool guardshack?

From an U.S. Army perspective via my experiences within the DoD IDES MEB/PEB process, the DoVA D-RAS shall provide proposed ratings on all PEB-referred unfitting conditions with rationale to include all DoVA claimed conditions/contentions listed on the applicable VA form during your meeting with the MSC. How many PEB-referred unfitting conditions do you currently have?

In my opinion, your Command shall potentially be held responsible since the medical community has officially expressed their medical concerns referencing your duty limitations. But, please continue to follow the limitations as annotated on the temporary profile and don't give your Command any opportunity to potentially use UCMJ non-judicial action(s) against you for not obeying their orders.

Moreover, I would suggest that you start a diary or log with dates, times, names, places and witnesses on site of all events which are not in compliance with your medical profile(s). Lastly, always remain on the legal side of military law to ensure favorable decisions are yielded if any unfortunate illegal events potentially occur while on official duty in my opinion.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

So updates on the Holiday timeline. I've been waiting to show up on transpoc and decided to call APDA. I signed my 199 on 09DEC and by 11DEC it was at APDA and assigned an adjuster. Then the next 2 days the "system was down" and monday was a snow day...The word on the street is they have about 800 cases right now. Hope i can come down on transpoc this week before the holidays and weekends stop all the work. Anyone shown up on transpoc lately?
 
My unfit memo was received by VA in Seattle on 11Sep13. Va completed my rating and sent them back to my peblo with the letter on 27Nov13. So they aren't only working July/August cause I'm waiting on 199 now.
Have you got your 199 back yet?
 
Part of me feels kind of sorry for the spouse's current PEBLO (third one this year). She is trying to make some progress, or at least encourage progress, but everything with him has been delayed, so we aren't terribly surprised the VA is still trying to rate him. She did email him yesterday that they are still holding for a rating, and it likely would be after the first of the year.

He had to present for an additional VA appointment about a month ago, and the best we could guess is someone is looking at his file, scratching his or her head and going "IDK what to do with this guy". Yes his file is complicated, and since the first permanent profile it has been four years, I guess resolution has to wait a little longer.

The sad part is that I belong to a MEDDAC and they should know better.

Wow! Yes, a MEDDAC; they definitely know better for sure!

From my experiences within the DoD IDES process, it seems that you MSC is potentially correct albeit he/she should have excess to the DoVA database application in order to yield a more precise response in my opinion.

Update my MSC got back to me today. I don't have another appointment they just need clarification on a claimed condition because the VA can't rate it. The last time they requested additional information on 4 conditions it took 7 total days, so today is day 4. I have good feelings that the end is near.
 
Nope Grizz, lol. I talked to MSC he said it is not. Says ebenefits is sketchy. Because of my circumstance of having an prior appeal at the "BVA" all these VA organizations are trying to coordinate all my stuff. Going on day 220 waiting for ratings. There is no end in sight. Wah :confused:
Then I suggest an IRIS inquiry would be worth your time.
 
Talk to the DVA today said they scheduled me another appointment. They couldn't tell me what the appointment is for or when it is. I know I'm close to the end, but its killing me that on day 137 at the VA and now I have a new appointment? My last QTC appointment was in June, and I am pretty sure I could of done this appointment a lot earlier in the process.
Go see your PEBLO asap and let them know what the VSO said.

Contact your PEBLO immediately, you also need to go see the MEB JAG/ legal and have written statements of your concerns and when you notified your CoC. Doing these steps will help protect you somewhat.

In my opinion they have no legal standing for you refusing to drive while on prescribed narcotics.
