@Warrior644 - No he really doesn't want TDRL. That is just what the Pueblo and attorney is telling him he most likely will get. Sounds as if you had to appeal the PEB. How did that go?

Well, unfavorable since I withdraw my demand for a formal PEB hearing two hours prior to the event as based upon my SPEBC attorney's advice of the three PEB members having a "strong indication" of a forthcoming denial.

But, I was recently approved for a second formal PEB hearing due to new medical evidence and I am waiting for the date/time/location information from the USAPDA NCRPEB.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Where can we find how much ROM plays in the decision of a rating? This is regards to a hip replacement.
 
@Combat Eng - That is funny my hubby is a Eng also! As far as a plan for when he is seperated. Well, he has a Masters in Engineering but the attorney told him not to go to work or get anymore schooling while he is on TDRL. He was told he would get TDRL due to the PTSD. The attorney said we don't want the VA to think he can work or do school so to wait until it goes permanent. This sound familiar to you or anyone else? After it goes permanent, then he will decide at that point what to do. We already own two houses so we are good there.

Ahh yes, and this is exactly why this process sucks, because of people like you. Scam the system. Great work.

If anyone is still watching this thread, I just got an update from the 1-800 number that my claim went in to the Preparation for Decision phase as of this morning. Not sure how long this will take until I see a 199, but hopefully it is soon. I've been paying my mortgage on my house where I'm moving back to and of course the rent for this on-post housing and I'm broke. Anyone have any idea about how long this will take?

James, on the 14th my eBenefits changed back to gathering of evidence and Requested separation documents. My Peblo called and said the VA rep gave him a copy of my ratings.

70% PTSD

For a total of
90% VA
70% army
I am now waiting on my 199.

Indeed congratulations on recent receipt of your DoVA proposed ratings!

To that extent, it seems that the SVT wasn't a significant factor in the DoVA D-RAS' evaluation on your rating for PTSD; good deal! ;)

Nobody is scamming nobody. Benefits are given to those that have paid in and are granted benefits by the system for proof of disability.

You said that your lawyer advised your husband to not work or go to school while on TDRL in order to make the VA think that he can't do those things in order to get a more favorable rating (in this case a permanent one vs a temporary one). That's the definition of a scam. It's dishonest.

You realize that there is a reason why they put people with PTSD on TDRL, right? The premise is that sometimes when people get away from the military their PTSD goes away or lessens, because the military itself can sometimes be part of what contributes to it. Therefore they are going to reevaluate those with PTSD later to see if that is the case.

I'm not saying that your husband doesn't deserve benefits. But getting more benefits than deserved by being dishonest is not the way to go about it.

True, typically on the back end because they are contributing to the ridiculous time that it takes for some people to receive their VA compensation after their retirement/termination date. I was just hoping that some other people would post some of their updates. It seemed like there was a lot of movement at the end of last month and the beginning of this month, but kind of slow as of late.
 
Let's get one thing straight Sir. I never said my husband COULD work or go to school right now. If he could, don't you think he would? He has a Masters Degree and is an highly intelligent individual. He would NEVER leave the military or apply for social security if he wasn't disabled. I won't dare let you call us scammers. That is incorrect Sir. You have no idea who my husband is, his situation, or what he stands for. For you information, the attorney was just doing his job of advising us on the rules for TDRL. Out of respect for my husband, the wounded warrior from battle, drop it!

Anybody dealing with Seattle should automatically get their mindset on it taking 4 months after unfit and anything earlier is a bonus, and if you plan on that it should be less stressful!

Also cmjames84 if your broke now from paying your a seperate mortgage back home you should be praying your ratings take Aslong as possible because unless you have a job setup waiting for you your income will drop till Va kicks in which can take up to 4-5 months

Thankfully I do have a job waiting, hopefully I don't "miss the boat" on... I need this over ASAP. I'm at 126 waiting for ratings.
 
So I checked my Benefits today and the status changed to Gathering Evidence and I freaked out and called my PEBLO. Turns out they requested my DD214 and sent my percentage, but it has not downloaded yet. Looks like my wait of 93 days is what it took and now the majority of the waiting is over. I should be completely done with the military by Febuary.

Holy S*** that was fast. By chance did you have a MH conditions claimed? I'm only asking because the OMBUDSMAN told me that claims with MH conditions take a lot longer than just physical conditions, with that being said I'm just trying to do some fact checking.
 
Just signed my DA199. I'm happy and grateful 70% DoD/ 90% VA. Better than expected. Was told I should come down on TRANSPROC in 1-3 days.
