I will post some thoughts on the filings in this case in the near future. For now, I wanted to point out that I have posted the complaint and several transcripts of case conferences in this case. I think it makes for very interesting reading.

I downloaded all of it and am going to sit down and read all the juicy bits!! I can't wait to hear your thoughts on the findings!!
 
I am part of this class action, but since I opted in, in January and received my PDBR filing paperwork, I have not heard anything. Does anyone know of any updates?
I filed my PDBR paperwork in February and finally received a letter from the AF in the end ofJune telling me that they were done "processing" my papaerwork and that they would now be fowarding it on to the actual PDBR. So I started the process in Feb and Its finallyt at the PDBR as of July. Does anyone know how long it can take from here? I am supposed to be a "Fast-Track" case but we all know how that goes. Any help on any of the questions I posed above would be really helpful. Thank you,

i am in the same boat, just waiting to hear.my paperwork was received in june. i called the veterans legal service in july and they said at that point only 10 had gone through the whole process and it could take 2-3 months to get any word. your paperwork was filed way earlier than mine, so according to them you should have heard something by now.if i were you i would give them a call, the number is on the lawsuit website, i shall be making the same call next week. hope this helps!
 
i called the nvls today and was told that now it could take anywhere for 6-9 months,from the time they received paperwork, to get any kind of response......so much for "fast tracking". i know there's to be another hearing next month, i truly hope it makes some sort of difference in the length of time we will all have to wait, because this is ridiculous!
 
I've been tracking the events of the lawsuit and received a letter for texas and I was curious as to if you've received any update from them since your last post. I'm 100 percent from the VA and was given 10 from the army so NVLSP says I'm good to go and not to worry. But, I'm stressed out about this time line. Are you still in the 4 to 9 month? Have you received anything? I hope this is a for sure thing. We need and earned it. I'd love to get all info that anyone in the lawsuit has. Their experience, time lines, back pay or whatever. Thaks for your camaraderie. God bless America!
 
I understand how you are feeling about the time line! I sent the opt in paperwork in July 2010. I call at least once a month for updates on my case. The answers I get every call is everything looks good, but they are waiting for the VA to send certify letter on my disabilities awarded by the VA (e.g. PTSD 60%, R Knee 10%, L Knee 10%.) This was September all the way thru December!
I am hoping the VA is not the cause for all the delays, but I would not doubt if they are. I am hoping to hear something for the both us soon! Take care and good luck!

Also am 100% from the VA (after fighting over 4 years) and 10% from the Army. Had opted in February 2010 for the lawsuit. Received a letter back in June stating that they was still waiting for papers from the VA. In the mean time I contacted the VA and requested all my papers to be sent to me, within 7-8 days, I received the papers and was in the process of copying all the papers so I would have a set for myself. I then received another letter from Texas stating that they had my papers (Wasn't this kind of fast after I requested them myself?) and my case would be going to the next step-this was about the 2nd week of July and since then I have heard nothing, but they are still working on them and they should let you know something soon. How long is soon!?!?!? I thought this was suppose to be a 9 month turn around????? Oh wait... their 9 month turn around is 2-3 years!!!!!
 
Thank you both so much for the response. It's nice to know I'm not the only one. I guess we'll find out what the story is at one point. I'll visit this site religiously and look forward to any updates. Oh, my doc# is in the 700's. Do we know we can use this as a guide for time? What is yours? I read someone had 300 something and his was done... Good for him! I hope we all get what the military stole. It's so wrong.
 
i still haven't heard a thing from them! my feeling at this point is we're all in for the long hull,i wouldn't doubt if it ends up being heard by the supreme court......even though its pretty clear "their" in the wrong. i have been in contact with the sabo family and i happen to know for a fact that they are STILL WAITING for some answer. i would love to hear from someone who has gotten good news on this front, because i'm personally losing faith in the whole thing!

I received good news from the PTSD Lawsuit. I recieved 50% permanent retirement from the Army. I filed my paperwork in February 2010 and the date of my final decision from PDBR/Army was Dec 27, 2010. They are supposed to be fast-tracking the Sabo lawsuit decisions at the PDBR so you will probably see something in 2011. Hang in there, I know it can be discouraging but if they owe you a retirement I believe you will get it.

u just made my day,just to know someone has finally made it through,lol.i'll just keep trying to be patient and keep my chin up. my family could really use the extra benefits,especially tricare.congratulations on your victory,kevin!
 
I called PDBR today and got an update on my case. The person said that my case was sent to the board in Oct 2010, even tough I opted in Feb 2010. After the board decides on it, it will go to the Army and I would receive a call and/or letter. I ask about the time frame for this to take place, would it be a few or several months? They responded and said that since I was part of the lawsuit, they was working on these cases faster than the regular ones??????????????? It was like hurry up and get your paperwork in and now that it is there, they take their sweet time!!!!! LOL
My question is this: For those who cases that have been decided already, does anyone care to share the time frame for their case. Some days I feel like throwing in the towel on this whole thing, but I have to keep kicking myself to go!!!!!!!!

All,

Unfortunately the processing time at the PDBR really sucks. Try not to focus on it and just make sure you have all of your paperwork where it needs to be. Ultimately there will be a favorable result for everyone that should have it.

Greetings Fellow Veterans,

I'm in the same boat with the rest of you, I was discharged Apr of 04 with 10% PTSD rating from the Army after 12 years active and 6 years reserve. I have a 50% rating from VA and have had a 30% VA PTSD rating since discharge. I opted in in June of 2010 and my packet was sent to Crystal City VA late Dec. 2010. I'm optimistic that I too will prevail and hope to hear my final disposition by June or so of this year if not sooner.
 
so i received some paperwork from the army review board...........it states that they retroactively placed me on TDRL for 6 months at 50%, gave me a re evaluation and then rescinded their findings and gave me 10%.......again.WTF is going on over there???i've tried calling the lawyers,but the number is incorrect..............has anyone else in the sabo case had this happen?where do we go from here? i waited all this time to have simply have my records changed to some fairy tale discharge that never happened? maybe i just don't understand,someone please help!!!

What was your VA rating for PTSD and from what date is it effective? Have you read DES Outrage 1 and 15? Was the review done by the PDBR or the ABCMR?

I have been going through the system ever sense Aug 2004 and in the Sabo case sense Jan 2010. I was transferred to the retired reserve in May of 2007 by the PEB with a 20% disability 10% PTSD and 10% back. I have over twenty years’ service, USAR. In Mar of 2007 shortly before the P EB I received a 50% PTSD and 20% back from the VA with some other stuff I got a total 70% disability from the VA. My paper work was sent to the PDBR in May 0f 2010. I called the PDBR this month and they informed me that they had sent my paper work to Crystal City in Dec and in Jan they had requested that the PDBR provide progress reports from the VA. Why would they be doing this? Are they trying to make an evaluation on me based on progress reports? I know the Air Force does not do it this way. If this is the case what recourse will I have? This has been a long drawn out process but I am prepared to see it to its final conclusion. If someone had told me the Army was doing this to its disabled Soldiers I wouldn’t have believed it.
