retroactive payment??

Hello all! Thank you for your help. Background info.

I was in the air force for 9 years. Got out in 2004, for an unfitting condition that happened during service. Was awarded 20 % for the unfit condition and 10% for a minor issue, not unfitting. I was paid around 20,000 for severance pay. 4 years ago, I was awarded 20% from the VA, for the unfit condition. I now get $980 a month.

In February, I got a letter from the PDBR, to evaluate my rating. I sent it back middle of March. IF, I get raised another 20% would I get a retroactive payment? Back to 2004? What would be the estimate? How do I figure it out and what do I consider? Does it take a long time to get it? Thank you for your input!!

What was your VA rating at the time you got out?
I didn't have a VA rating when I got out. I didn't Pursue a rating with the VA until 4 years ago. Thank you for your time to answer my question!

I think you are going to have a hard time getting a retroactive retirement from the PDBR, however with that being said, you should still pursue it.

Why I think you will have a hard time is that since you did not seek any medical attention with the VA for four years, this can be used as a justification that the condition was rated correctly. Then once you did get rated, the VA gave you the same 20% that the legacy DES did.

Still go for it with the PDBR, getting a retroactive retirement may put a few bucks in your pocket. Your medical retirement at 30% should be about $600-$630 per month.

Thank you! I did see my regular doctor about my condition and the VA has records of it. It isn't a treatable condition. I have a blood clot in my leg, which tests prove it is still there. I have been seeing a VA doctor for the past 4 years, but did not see them from 2004-2013.

If you read what I just posed a while ago, do you think that makes a difference? Thank you!

I am so sorry! I keep thinking of more and more questions as I read through other information. Thank you so much for helping me!

As I said before, I got out in 2004 due to a blood clot in my leg, most likely caused from frequent flying. The blood clot isn't treatable. My family doctor checked on it a few times between 2004 and 2013. Tests show the blood clot is still there. The VA has all my medical records from my family doctor. My leg with my blood clot has also cause problems with my knees and ankles, which I stated in my form to the PDBR.

In 2013, I applied for VA benefits and was awarded 20%. I started going to the VA for medical check ups in 2013 and have been going ever since.

My questions:

1) You stated that the fact that I didn't get a VA rating or that I didn't go to the VA for medical attention might hurt the decision with the PDBR?

2) What exactly is Medical Retirement? You said $600-$630 a month? Is that on top of what I get now? Surely not. I got 20% for my unfit condition and 10% for another, not unfitting. I have a total of 30%. I was awarded the 20% from the VA in 2013. So, I have a combination of 50%? I get about $980 a month right now.

3) I was doing some research on how they choose the rating. I have stasis pigmentation(discoloration) to my leg, caused by the blood clot. It looks like 20% doesn't include stasis pigmentation, but 40% does. I know that on my DBQ, it states that I do have it. I know my VA doctor also has it in his notes. I also have an appointment soon. Did VA just give me 20% because DES did? What are the chances of PDBR increasing it because of that?

4) You don't think I will get a retroactive payment?

5) Any advice?

You are so great for taking your time to answer everyone's questions! Thank yo so much!

I literally feel like a crazy person asking all these questions!!
I made a mistake, it isn't the "stasis pigmentation" that separates 20% from 40%. 20% has beginning "stasis pigmentation" and 40% just has "stasis pigmentation". It is "incompletely relived by elevation" that separates the two. It has "incompletely relived by elevation" on 20% and not on 40%. My leg is consistantly swollen, it never changes. The only time it changes is if I am on my feet all day or running, it is even more swollen. I know you are a doctor and this is irrelevant.

My main question is if the VA awarded me 20 despite all this, will the DES even change my rating?
