Reservist 3900 points / 20+ SAT years / LOD / ?????

I wasn't sure where to put this but looking for some guidance or input into what will occur:

1. I'm a reservist with 3900 points / approx 7 years active (2 combat deployments) / 23 SAT reserve years
2. Received VA rating in 2019 for 100 Permanent and Total (Still in reserves) 100 PTSD / 70 TBI / 30 Migraine
3. Dec 2020 placed TNPQ
4. Feb 2021 LOD assigned for PTSD / TBI / Migraine
5. Currently awaiting fitness for duty and entry into PEB process.
6. Family enrolled in CHAMPVA

Questions:
1. Will I have to go back through the VA evaluation process or will the board use the current VA ratings and evaluation?
2. If given a DoD rating will I receive DoD retirement immediately or have to wait until 60?
3. Will my family receive or be eligible for Tricare?

1. Depends on if you choose IDES or LDES. IDES you will have to do the exams at the VA again. LDES you will not. However, I am a strong advocate of IDES because of the protections used for the Soldier. In IDES the military must use the VA rating for determining the DOD unfitting condition. LDES they do not have to. LDES is shorter. IDES is longer and in your case repetitive but I would still go that route so that if the results aren't what you like you have multiple steps to remedy them.

2. If given DOD rating from LOD you should get an immediate retirement as long as the unfitting conditions are rated 30% or greater. If less than 30% you can decline severance and get retirement at age 60 or sooner depending on if deployments lower that age. Unless you qualify for CRSC any VA disability amount received will offset your medical retirement until you are eligible for a 20 year retirement. So at age 60 you could apply for regular retirement and then CRDP would allow you to get both with some caveots such as you can't get more restored than the longevity portion of our 20 year non regular pension.

3. If medically retired yes. Some thing for at age 60 with non regular retirement already earned. I do believe if you do get Tricare for the family you will have to disenroll them from CHAMPVA. You can only get one.

Within the LDES what do they use to calculate the rating? My concern would be the possibility of loosing my current 100 PnT.

Yeah that's why everyone runs to LDES. However that's a decision based on fear not logic. If you are still 100% disabled then going to another VA exam for the purpose of getting rated in IDES shouldn't be an issue. If you believe you're not 100% disabled then we're getting into an ethics discussion that I'd rather not have. LOL.
 
Valid point. Thank you. Never expected that rating however and after years of treatment it hasn't improved. The DES makes sense.
 
Hey Gorun, hope this helps, I medically retired and have 20 yrs as a guardsman. Around the same points, I get Tricare prime as a regular AD reitiree it’s only 50 dollars a month. From the ratings I see, which ever disability they find you unfit it would qualify for medical, make sure to apply for CRSC as we don’t get our retirement right away. It’s a lot of paperwork to submit for CRSC but if you want more money, you have to go get it.
