i received ratings from PEBLO to look at my refering condition was migraines they gave me
DOD 30%

VA Ratings

Sleep Apnea 50%
Arthritus Right foot 30%
Common Migraine 30%
PTSD with insomnia, anxiety 30%
Cervical Strain 10%
Allergies 10%
Tinnitus 10%
right and left knee patellofemorel syndrome 0%
Hypertension 0%
TBI cuncussion 0%

total 90%

They told me need to raise another 5% for 100% dont understand the VA the 0% have better documentation then the other rated stuffbeen on 2 different blood pressure meds since 2004. on and off physical theripy for knees in the last 3 years. Been in a IED blast where its documented I was knocked out head hit windshield. been seeing TBI doctor for 5 years. The rated stuff only seen docs a few times. My PEBLO said dont appeal VA wait till get 1st pay then try to increase or add to is that true? What should I do? been in almost 17 years. Said for Migraines 30% PDR he rarely sees its usually TDRL or under 20%. I would have been happy with severence I single. He looked at me like I was crazy why would to turn down healthcare and rely on VA
 
Sorry I don't have an answer since you are further along than I am, but I do have a question. After I did my VA claims, my Neurologist discovered a straightened Cervical Lordosis contributed to my Neck Spasms & Migraines. Is that pretty much the same as your Cervical Strain condition? What evidence did you have documented?
 
I just keep a headache log on my phone and email it to my neurologist every visit also the VA exam X-Ray found the cervical stuff I did not even claim that at first
 
I would take the offer. Don't sweat the VA stuff because when you get out and go to your VA appointments they will add it in to your reconsideration. Don't be surprised too if they lower or change other things. From my understanding from listening to other people it happens. Their not looking out for you, only you can do that.
 
VA has a pretty limited list of migraine meds they can offer, and at half the doses. Had to go to TRICARE to get mine refilled.

The VA ratings are proposed, once they receive your DD214 they will reopen the claim officially. You can submit additional evidence and in theory they should consider it before making the ratings official.

Knees are all based on range of motion. If you can get your physical therapist to write up the ROMs better than the C&P doc it may be decided a different way. Even if he just notes that you have pain on movement that's 10%. 3 years of treatment doesn't get a rating, if that treatment was successful.

The VA math is very non-instinctual. You are at 86% disabled, rounded up to 90%. They consider you 14% abled, you would need about 70% more disability to become 10% less abled and get 100% VA.

50% disability = 50% abled
30% disability of 50% abled = 15% disabled for a total of 65% disabled and 35% abled
30% disability of 35% abled = 10.5% disabled for a total of 75.5% disabled and 24.5% abled
30% disability of 24.5% abled = 8.35% disabled for a total of 82.85% disabled and 17.15% abled

etc.

They use a little chart to do each step, so rounding errors come in, I just did mine in a quick excel.

Did the "V" codes on your 199 grant you combat/combat related for your injuries - especially for your TBI?

Remember, you may also qualify for CRSC.

Actually did an appeal today for the V codes the attorney had my packet for 3 days said its cut and dry and it should be coded with the V code. I hope he is right he said it will be a $1000 difference CRSC he showed the numbers said it don't hirt to try. Just hope I don't lose anything

I am in no hurry my unit is they already had me give up my desk computer I don't even go into work anymore I just have to text that I'm alive. They just gripping about my award Im like I don't need one. Said I have too makes unit look bad when I'm clearing 17 years no award

I feel your pain... I am 23 years not award or OER. I am not going to worry about things that don't matter. Good luck with yours.
 
JAG sent me an email that the president of the PEB wants a statement from me to justify a V1or V3 code on the appeal. I won't take it all the way formal if the don't they don't dont want all that hassle. Just for migraines the way the Narsuums written is cut and dry. The only extra the V code is CRSC if HRC approves it because that's another step I heard is not easy. What's anyone else's opinion I typed my statement. If the board don't budge can I just sign and take my original offer
 
CRSC can make their decision independent of the PEB, so its safe to accept a wrong V code. Personally I would gather my evidence I had to justify CRSC and submit it up to see how the PEB responds as free feedback to how good the evidence is. If they approve, that just more evidence to support CRSC as you can then submit the 199 along with the evidence. If they disapprove, well then you know its a good idea to gather more if you can.
 
I got news from Lawyer today won the appeal here is their reply
" Mr xxxx, thank you for your follow-thru. The Board agrees w/ SSG Xxxxxxx and will add a V1/V3 designation to his unfitting migraines. Please acknowledge that your client accepts our offer. Also, does SSG xxxxx have additional requests of the Board? Thank you for the
assistance.

So I will be accepting and my new 199 should be ready by end of week what timeline on orders after signature off 199?​
 
Approximately 2 weeks you'll have orders with a separation date.
 
Thanks so fast. A lot of mixed emotions been doing this since 18 years old I am now 44 units treating me like a retiree and not a med boerd. Put me in for MSM. I just wish all was active years and I made it to 20. 10 NG over 16 active
