Received DBQ for MH - Assistance/Guidance needed

Good morning,

I just received my first DBQ for my MH referred conditions of PTSD, Social Anxiety Disorder, and Bipolar, unspecified. My C&P exam was done over video as I was informed there were no available in-person MH appointments in my area. After what appeared to be 15 minutes on video with the Dr. she rapped up the appointment and stated she would review my files and fill out the DBQ. Upon my review of the DBQ, it appears the file is grossly incorrect or that she may have even mixed up my file with somebody else. Overall she has me rated at 30% according to the total occupation and social impairment. She even wrote incorrect statements such as I have been married for 18 years. She missed a lot of my symptoms too. How can I ensure prior to my case being finalized that this gets corrected? She confirmed my diagnosis and referred conditions, but still is only rating me at 30%. My conditions are much worse than what it appears on paper, to include my inability to work. I just do not know if I have what it takes to continue the fight. Any help is appreciated.

File a VARR you can contact the contractor that scheduled the exam too.
 
For those who did not know this, before your case is finalized if you happen to see a DBQ and you do not agree with the findings because the package was messed up. You are able to contact QTC ask for a re-evaluation and have another DBQ filled out by a VA contracted doctor.

I spoke to QTC and they said that the va has to make another request for another c&p exam. Is that correct
 
Its correct if they believe the examiner did not make an error.
 
If there is gross error the contractor will want to do a re-do.

Hello I’m new to the forum but I was hoping to get some help


Just to give you my background.

I was separated in April 2002 for personality disorder, Which didn’t exist, I was diagnosed with MDD and PTSD by VA in October 2016 100% P/T.

I contacted NVLSP in 2016 they were kind enough to be me in touch with a pro Bono attorney who is awesome!

December 2018 the Army Medical Review board confirmed they received my application and evidence (put together by my attorney)

October 2019 my attorney asked for status update and we were told a Medical Advisory would be needed. I nor my attorney received a copy of it. I don’t know if it was completed or if hearing nothing about it is a good thing.

February 2021 my attorney told me to do an congressional inquiry which received an almost immediate response from the Army medical review board stating that my case is “under-going post board reviews” I don’t know what that means.

March 2021 my attorney emailed the board for an update this was the response “
Ma'am,

I cannot provide a specific timeline for completion, but can assure you that the case is being processed as quickly as possible.

You and your client will be notified directly once a decision has been rendered and finalized. Again, we appreciate your patience during this process.

I have a POC (just a nice lady who was willing to help) at the PDBR who said my case hasn’t reach her office yet, but it could possibly be there but not entered yet to be worked.

Does anyone have any experiences with the board dealing with wrongly diagnosed personality disorder cases that have turned to medical retirement?

Any help given is appreciated
