Rating questions

Hello,

Questions concerning ratings. I received my Narsum back and of course appealed. Received secondary review back and will still appeal. My questions pertain to meeting retention standard. My right shoulder had an AC seperation 7 years ago, continually deal with residual pain, numbness and loss of strength. I can't do my warrior tasks because I can't fire a weapon, of lift over 15-20lbs. I have had a P2 for the past 4 years and not allowed to due pushups because its starting to sublux. I am a nurse by trade and was removed from the floor because I can't lift patients but according to the doc's my shoulder meets retention. I have read the reg's and I don't agree with the doc's. Am I right? Or am I missing something when I read the reg's?

Does your profile reflect a "No," in the columns for using a weapon, lifting combat load, moving between fighting positions? If I remember correctly those being marked no was the nail for MEB. If you can't perform your warrior tasks then your suppose to be retired.

I assume your Narsum is stating you are fit for duty? Have you gone to JAG? Gone to pain management? Surgical consult? Trying to see if you have been following up with it or just trying to get by. That is an issue most people try to tough it out because that is what the military wants, then you break for good and they say nothing could be wrong since you have not been trying to take care of it. Double edged sword for most of us.
 
Thank you for your reply. Yes, it states no for AWT. Yes, your correct says meets standard. I have gone to pain managment and have notes explain my weakness and pain in my shoulder but neither reviewing doctors looked at my ALTHA notes just went off the C&P exam. And speaking of the C&P exam, what a joke. I work in the medical field and know how it should be conducted. The guy didn't check boxes and lied about doing a full assessment. I questioned him at the exam but still was stuck with an incomplete exam. Yesterday the DCN wrote a letter on my behalf and my Commander rewrote the DA 7652 in a more detailed manner by stating can't carry loads or weapon. I am fortunate that I have individuals in the chain of command who are supportive.

Did your pcm check your ROM I think that plays a huge part in the meb process as I am be med for both shoulders. I don't think they care that much about pain in my own opinion. Make sure they check your ROM with the geometer.

Yes the ROM was checked but the C&P doctor didn't use the gionometer which I did state in my appeal. According to the doctor I appealed to they can only go by what's in the C&P exam, which is a bunch of nonsense.
And talking about the injustice in this process. I don't know about other places but at Fort Gordon the first doctor calls you over the phone, when you appeal the second doctor sits next to the first doctor so the pot is tainted. When it goes to the informal all three doctors who signed your NARSUM make the decision on your appeal and rate you. I was told that I couldn't use my PCM for my secondary review and had to use the doctor sitting next to the first doctor at the WTU. No soldier gets a fair shake from this process because you aren't really getting an independent review.
 
I wouldn't want my PCM to be apart of the MEB process other than reffering me to the process. Due to the fact that he is only a PA with a Masters Degree and is not an MD. Yes they due the ratings off the C&P exam but the fact that he didnt use the ROM tool is a red flag.
 
yea they have to used the ROM tool that's just wrong to try and eye ball it that's where your ratings coming in base off your rom.
 
You can appeal once your 199 returns for a VA reconsideration. I was reading that if a veteran goes a civilian provider that is more or equally qualified and provides an equally complete exam as the C&P they must side with the Veteran. That is, if the independent provider report reflects a different reading.
