I got Lackland on 10 Sept 2010. I will be at 20 years on 28 Nov 2010. They have recommended me for Discharge with Severance Pay.

I have been passing my PT Test for the last three years with no problems since I have been finally diagnosed with degenerative disc disease.

I also made E-7 this year as well. MY line number is 942. I should probably put it on around 1 Oct. If I still can. I haven't received any official word yet. I have started the course 14 and am planning on being returned back to active duty. Hopefully!!!!

My doctor off base doesn't recommend surgery at my age at this time. He stated that as long as I can tolerate the pain do it. When I can't stand it anymore then have surgery. I figured would be better in my situation to stay in longer.

Any advice would be helpful. Thanks

Can they do that?!!! That seems pretty wrong to seperate you at 19+ years... I know I've read something that prevents this, or some sort of recourse at least!!!
 
Tell your PEBLO that you want to apply for LASP, since you have over 15 years service. you want to be able to get to 20 in order to retire. If they give you grief, apply to the FPEB. your goal- get to 20!!!
 
Or throw down your retirement paperwork, effective up to a year from when your throw it down. When the MEB see that you already have retirement in, then they usualy cancel it.
 
You need to get your 20 year retirement for longevity. At the minimum request a formal PEB. That should get you to 28 Nov 2010, DO NOT TAKE THE SEVERANCE PAY!!!!!!!!!!

As XENO says, drop your retirement paperwork on them also.

Since you are already in DES, I do not think you can drop retirement paperwork (well, really, what this means is that your retirement request should be denied based on Code 37/your status in the DES.

It is unclear if you should be rated higher (i.e., get a retirement finding) or should argue for fitness. But, if you do not prevail in a retirement finding or fit finding, Limited Assignment Status application appears to be the way to go.
 
If this was only the MEB you can easily drag this out through November by requesting your paperwork go to IPEB.
 
You might want to check into Sanctuary. If I remember correctly, if you have over 18 years service you can claim sanctuary to finish out till retirement. I am not to familiar with how the program works but it might be worth looking into.
 
If it were me, I'd appeal to the PEB. While waiting on the appeal, have your ROM test checked by another party. Some recommend not taking pain medications beforehand and stopping at the first point you feel pain. Your range of motion measurements seem too optimal given the amount of distress you appear to be in. If you have any other documented medical conditions that could result in an unfitting condition to be rated--now's not the time to suck it up. Ringing in the ears, hearing loss, dizzness, etc could all be found unfittting. There's little mention about your duty limitations--were they well documented? What does your profile say? If new unfitting conditions are discovered, it could result in a new MEB and IPEB. IN any case, November is not that far off and any delays to your final disposition at this point would be welcome.
 
Update! Arrived at lackland yesterday afternoon. I am now in the waiting area of the PEB attorney office awaiting the 0800 inprocessing time to start. I will let you know how things progress. To everyone who has commented so far TKS!, for your input.

How did it go? I was told by my JAG lawyer at the PEB that the SAFPC cases are taking at least 8 months now to process...so u can always go that route if the PEB didn't work out.

No one else has hit on this so I'll throw it in.

AFI 36-3212:
5.15.4. Members who are retired on or after 23 Sep 96, may be retired in the regular or reserve grade to which they had been selected and would have been promoted, had it not been for the physical disability for which they were retired. (10 U.S.C. 1372 was amended effective 23 Sep 96.)


You said you had a line number for MSgt. So, even if you have not put it on by the time you get out, you should be able to retire with it.

I found it once before, basically after 18 years of service up to the 20 yr mark only the secretary of the AF can put you out. I don't know if this applies to the medical board however.

If you are going to the Formal board on 10 Sept, you will have 90 days after the decision before being discharged. I'm just learning all this but someone can correct me if I'm wrong.

I think you are talking about "sanctuary." The thing with sanctuary and medical boards is that the PEB makes recommendations, but technically, the decision to separate/retire someone is actually made by the Service Secretary. So, sanctuary does not work to block disability outcomes.
