Good Morning.. I have a question regarding receiving a permanent or temporary profile. My husband is going through the IDES process. He has been rated as 100% Permanent and Total on the VA side and 90% on the DOD side. Additionally, he has 100% on the VA side even without PTSD. PTSD is not listed on the DOD side at all, and he still has 90%. He is trying to get his PTSD, which is 70%, added to the DOD side and rated as combat related to get the tax free benefits. It is noted he has a combat action badge to make his PTSD combat related which they currently don’t have it listed as. His PEBLO has told him if they add the PTSD to the DOD side his status will change to a temporary profile for 6 months. Is this true, even though he is at 100% even without PTSD on the VA side?

He will be Temporary for at least six months because according to regulations, he must have a reevaluation for his PTSD within six months of discharge to see if his PTSD improves. I had basically the same situation and received my orders for the TDRL on 18 June of last year. I had a reevaluation for PTSD in January of this year (2024) for the VA but have been told that my reevaluation for the DOD will be pushed out to November/December time frame of this year (2024) due to increased number of medical retirements. My VA reevaluation went well and now I am P & T for the VA - just waiting for DOD to schedule me for my reevaluation. I've been told it will be by phone. Since the VA continued my PTSD rating and made it permanent; hopefully, DOD will follow suit.
Also, its possible to get everything tax free without adding anything. Unless your husband reaches 20 years active duty retirement or a 20 year letter for the Guard/Reserves and has reached age 60 any VA compensation received will offset his chapter 61 medical retirement. Its common to receive VA pay and tricare with no pay for your medical retirement. If he gets PTSD added and designated by the PEB as combat related then his chapter 61 pension is tax free. However, due to the VA offset requirement its likely that his tax free chapter 61 pension will be completely offset by tax free VA compensation. So its a wash.
Also, after getting out and receiving his official VA award letter he can apply with his branch of service for CRSC. If he qualifies for it he can receive an extra check that is tax free from DFAS. CRSC is tax free too. You can't get more compensation the combination of his earned longevity pension + VA compensation. So for most, the longer they serve the more they can receive from CRSC since their earned regular retirement that was lost was worth more. There are many caps for CRSC not just this one even though its the most common.
