This is off topic but just had another appointment today, I am going in for my second shoulder surgery and apparently if I had refused surgery I would be recommended but because I want to be fixed I'm being punished.....wow. Maybe someone can weigh in though between pain and loss of rom in shoulder and back can I hit that magic 30% dod? Do appeals generally end up with higher ratings?
The way the regs and laws are written and from a general word usage, being involuntarily seperated is a negative finding. Them not putting you in the MEB process is hard to view as a punishment.
Beyond that though, they rate off level of disability, not diagnosis. Obviously they cannot know what your disability level is until they know how successful your treatment is.
