PTSD and TDRL

I am currently going through the MEB. I am in the rating phase. My unfit conditions are PTSD, Social anxiety disorder inclusing panic disorder, and a left shoulder osteochondroma and Acromioclavicular strain.

From what I understand, my PTSD will most likely result in TDRL. I have a few questions.

My NARSUM indicates that it (PTSD) is reccurent and occured back in 2010. Does this make it more likely that I will be granted PDRL? It seems like most people are placed on TDRL for PTSD.

I am terrified of being put on TDRL, because that basically means limbo. I still wont know how the military will find me in 18, 36, 48 months ect. This process is stressful enough. I can't imagine this being held over my head for a potential 5 years.

Although this isn't my ideal outcome, I would like to have as much information as possible, so I have a few additional questions.

Is it worth the fight to obtain PDRL if placed on TDRL by requesting a formal board?

If you are rated over the 50% by DOD will you still only be paid 50% of base pay?

Are other conditions taken into consideration when determining TDRL vs. PDRL?

I have a family, and a special needs child, so I am just trying to plan as much as I can. I appreciate any insight. I just want to be able to move on with my life, and really focus on bettering myself, but how can someone with excessive worry, stop worrying when it comes to this process?

I feel like I'm losing my mind.
 
I have another question.
When I had my C&P for PTSD the social and occupational impairment portion and other parts fell under 70%.

Is there a cut off where a certain percentage warrants PDRL?
 
No. What matters is if it likely the condition will improve or worsen enough to affect the rating.

If your ratings are higher than 50%, your retirement pay will be at whichever percentage your rate is up to 75%, which is the highest DoD retirement pay will go. If you are rated at 70%, you will receive 70%, but if you are rated at 80% or more, you will only receive 75%.

If you find the magic formula to get PDRL with PTSD, please share! (It's not likely going to happen unless you have a very high percentage of unfitting physical disabilities as well). I hate it, too! It's very stressful!
 
My Soldier counsel told me that all PTSD type of disorders are placed on TRDL and recalled 6 months after they get out to recieve a re-eval. Basically told me its to cover the Army butt because they got sued for it prior. He also told me that he never had anyone with PTSD rating go lower. He is the lead counsel at JBLM, not that it matters just throwing it out there.

Any one know how the CRSC works? I recieved my unfit memo with V rating all stating yes, from my understanding they meet the critrea for CRSC. How do they figure the % for it?

Also agree stressful. Trying to guess % and figure out dollar amounts to have an idea so when I get out I am not out there flapping.

The VASRD (4.132) requires that anyone released from active service due to a PTSD be rated at least 50% disabled and reevaluated in 6 months. For years, the Army and other services were ignoring this requirement and rating the PTSD at 0 or 10% disabling and separating the member without disability retirement. Thousands were illegally denied disability retirement by the military ignoring this requirement. There is a whole sorted history of the services low balling disability ratings to avoid paying disability retirement and PTSD suffers were all too often victims of this practice. I was deeply involved in fixing this problem.

You need to file for CRSC with the Army.

Thank God you were on the front line on this issue maparker!

Before this PTSD issue got a "new and improved makeover", SMs were getting screwed and tattooed by the hundreds and hundreds - for years!

And while this is still not a perfect system, some aspects of the many PTSD issues are seeing some slow, but forward movement.

Your taking up the battle cry and pushing forward for change was instrumental in creating a watershed moment.

I checked Ebenefits this morning and it moved to prep for decision. I'm not sure how accurate this is, but it was stuck at review of evidence for a LONG time. Do TDRL ratings usually come back faster? If I do recieve TDRL will I also get a VA rating?

Does Prep for decision usually mean I will get my ratings within the next couple weeks?
 
I am freaking out. If this Pending decision non-sense is accurate, I am wondering why my wait time is so short. Hopefully this doesn't mean they slapped me with a big fat 0.
 
Don't freak out over anything EBenefits says. It seems to cycle through and none of it necessarily means anything at all. Ignore it if you can.
 
If you are awaiting your first proposed ratings (as it seems), stop stressing about that right now. You still have other avenues to pursue if you do not agree with them. It might help you to look at some of the timelines that people have posted as to how long things take in this process. I know it isn't easy, but stop looking at eBenefits, it will just drive you insane. Instead, use the energy to focus on clarifying your desired outcome and prepare your argument in case you need one later down the line.
 
I need some help with my situation....I was medically retired out the Army on Nov 27, 2013... I was awarded 90% for my unfitting conditions on the DOD side(Army) and 100% on the VA side for all my conditions. I was put on the TDRL because of PTSD. My rating for my unfitting conditions went as such:
PTSD 70%
Chronic Migraines 50%
Back issues 20%
right foot 10%....
I have been seeing a psychiatrist at the VA....Also, the VA sent me to a C&P exam on Monday...I got a letter from the VA yesterday that my PTSD at 70% was increased to 100% and it says it is permanent & total and my eligibility for Chapter 35 is established. I was wonder do I still have to do an exam for Army or can I send the paperwork from the VA to the Army and ask them to change me from TDRL to PDRL.
