Proposed Ratings- Appeal additional claim or not

Currently in the MEB process and I received my proposal ratings from the VA yesterday. Overall, pretty happy.
However, here’s my issue. One of my claims was that I had an ovarian cyst, ovary, and Fallopian tube removed in 2018 and the lab results came back pre cancerous. Since then, I have followed up with a GYN oncologist every 3 months, recently switched to every 6 months. I will have to do this for the rest of my life. I received 0% for this, but in my letter when it explains how to get the next rating, it states “symptoms that require continuous treatment”. Does this not count as continuous treatment?
This is NOT my medboard condition, just an additional claim. I absolutely want to fight it, but not while I’m in if I have to. I’d rather try to raise it once I’m out. But are my odds better fighting it while I’m in? And if so, what documentation do I need showing I need continuous care?
 
I think the "continuous care" is more about the symptoms being continuous and how they affect both your quality of life and ability to work. For example I have musculoskeletal injuries that I had failed surgeries on and now have ROM and significant pain which will get a rating. On the other hand I have a tear in a joint that isn't causing me ROM issues or pain (for the time being) so that will likely be rated at 0%. However, it is annotated so if it becomes aggravated after service I can appeal my percentage. If you are happy with your ratings and ready to move on with your life, get out and monitor the symptoms then file another claim for it if things worsen.

That's going to be a tough one! Getting checked regularly would not be considered continuous treatment I wonder if you could add a claim for cancer though? Not sure if pre cancerous counts. IMO I don't think its going to matter too much whether you try to fight it now or later on since its not an unfitting condition. Also, you might want to check if there is a connection between the removal of your ovary & Fallopian tubes and the pre cancer cells detected. I am guessing that you could have lab work come back pre cancerous regardless of whether you had the other stuff removed.

Completely makes sense! I wasn’t sure what exactly they were looking for in the “continuous treatment” so thank you for explaining!

The pre cancer cells came from the cyst that was removed. I do bloodwork every 3 months to monitor my cancer ag125 count. So far I’ve stayed under what it needs to be so that’s good

Gotcha. Then they are related!
 
File any secondary claims if you have residuals from the surgery. Cancer ratings are tough if you are in remission/ cancer free they SC with 0%. Just know if anything comes up in the future you can file for an increase a 0% rating is still good rating because it makes it a whole lot easier to file an increase at a later date if need be.
