So I was medically discharged at 50% for PTSD in 2015, depression, anxiety. I was placed in Tdrl and while on Tdrl I transitioned to civilian life. One day I had an episode in my home and I began to throw stuff as I could not control my anger. I ended up with a misdemeanor domestic battery assault. I did not hurt my wife but she was scared for her safety. Anyway I am scared about where that places me in regards to Tdrl. I know you're medically evaluated to see if your fit for duty, I won't ever be able to hold, own a firearm so does that mean I will be placed on pdrl? Will they just stop my Tdrl case?
 
Being charged and being found guilty are two different things in regard to the firearm.

If anything, in my opinion, this episode would support PDRL. However, self-control, drugs/alcohol abuse, or anything like that could hurt your case if there is a history because it blurs the lines between what is causing the issues - PTSD or the Alcohol/Drugs, etc.

From an U.S. Army perspective while still currently on the DoD military TDRL for PTSD since May 2014, no as I see it. In fact, in my opinion, it could be evidence to show/prove continuation onto the DoD military TDRL since the condition may still seem to be "unstable" for disability rating purposes at this point in time.

Bottom line is the Military branch of service's PDA which placed you onto the DoD military TDRL shall forward your TDRL case file to their LDES PEB for evaluation at a designated point in time initially decided by the IDES PEB while not exceeding 18 months from any previously applicable TDRL evaluation.

Hence, if your PTSD medical condition was evaluated by the DoVA D-RAS under 38 CFR VASRD §4.129 Mental disorders due to traumatic stress, then...

"When a mental disorder that develops in service as a result of a highly stressful event is severe enough to bring about the veteran's release from active military service, the rating agency shall assign an evaluation of not less than 50 percent and schedule an examination within the six month period following the veteran's discharge to determine whether a change in evaluation is warranted. (Authority: 38 U.S.C. 1155) [61 FR 52700, Oct. 8, 1996]"

As such, it could seem that your TDRL (initial) evaluation should be forthcoming (if applicable) and the symptomology from the TDRL medical examination (to include all other available medical evidence/documentation) needs to show that your PEB-referred "unfit for duty" medical condition(s) is(are) now considered "permanent and stable" for military disability rating purposes only in order to be placed onto the DoD military PDRL.

With that all said, please continue to seek and obtain behavioral healthcare treatment nonetheless. Take care! :cool:
