PDRL offer, follow up VA appts?

Active Duty Navy diagnosed with Crohns.

DOD rating is 30% for Crohn's Disease.

Combined rating from VA is 80%

This puts me on the PDRL which gives me a disability check and medical coverage for life, correct?

I spoke with the attorney this afternoon and he would like to see me do a reconsideration on my findings, based on his belief that I am closer to the 60% mark for Crohns. While it would only change the overall rating (80%-90%) he says that it will protect me in case the VA drops my fisutla percentage down. The attorney did say the odds that I'll ever be called on by the VA are slim and even less of a chance that they'd drop my percentage.

I was under the impression that one you are on the PDRL it's permanent. Further, in my VA proposal under "Future Appointments" it says "None".

So for any experts, what is your take on this situation? Thank you in advance.

PDRL is in regards to DoD only. It guarantees a percentage of your base and healthcare for life. However, it does not cause the VA to make a finding of permanent and total (P&T) or not.

You may or may not be re-evaluated. Just because it says no future appointment does not mean a re-evaluation won't happen.

As long as there is enough evidence for the 30% and you are not concerned with dropping below that threshold I see a benefit to the reconsideration. However, you need to look at the financial picture and see what effect a change would have and if you're content with waiting longer.

Once on PDRL you are locked in as far as the Army side goes. On the VA side, they could evaluate it later and adjust the percentage, but it will not change the Army. The Army is putting you on PDRL based on the "now" and not what happens in the future.

Hello Drewpydog,Thank you for your service, are you saying that your VA rating is an 80% combined rating and that it says no future exams? Are you 80% IUT&P?(Individual Unemploability Total& Permanent)?

This I beleive is the only way that you can have no future exams with the VA is that it must be IU or 100% schedular P&T no future exams. Some one please correct me if I am wrong. I dont
know what the lawyer is talking about.

Stop and read your VA award letter again before you do any reconsiderations as you may
already be receiving a pay at the IU level for VA.
