NTC after being found unfit????

OK so here is my terrible situation. got a call about 10 minutes ago saying that i am going to NTC 1 September. I have already been found unfit and my packet is with the VA. everyone in my chain of command understands this, yet my BDE CDR said anyone undergoing an MEB "WILL GO TO NTC WITH US". Can anyone offer some advice or cite a regulation that i can bring to him and say this is why i can not go to NTC??? thanks in advance
 
I think you should go to your case manager, assuming you have one. Or even your PEBLO. If something changes and you must make a medical appointment, you will be unable to do so if you are at NTC. If you have to IG may be able to assist as well. It's hard to use the chain of command when the BDE CDR makes a statement like that. But perhaps based on your medical situation, a BN CDR can expalin the circumstance to the BDE CDR to change his mind. Just an idea.
 
I would get with your PEBLO to see if you can get some support. You are supposed to remain available for MEB/PEB actions. See AR 635-40, Appendix E, "E–4. Administrative control of Soldiers before final PEB action
a. Soldiers processed as outpatients will remain available to the MTF commander or president of the PEB until the
PEB completes action in his or her case.
b. Soldiers processed by MTFs in attached status will normally be retained at the MTF until PEB processing is
completed. The Soldier may, however, be authorized to reside elsewhere pending completion of PEB action.
c. Soldiers processed by MTFs in assigned status normally will remain at the MTF until PEB action is completed.
The Soldier may, however, be authorized to reside elsewhere pending completion of PEB action."

Seems to me that if you are at NTC, you would not be available as required. A separate issue is if you should be performing duty at NTC as it may be outside of your profile (I don't know what your limitations are, but the point is, there are two issues- your availability to act on your case and your medical status/ability to actually perform this rotation at NTC). For the latter, you may check with your doctor (maybe-your brigade surgeon, but I am not sure how sympathetic he may be and you may want someone outside of your chain looking at the issue as they may be more objective).
 
ya, according to AR you cannot go TDY, deploy, etc while going through the MEB process. No way do you have to go to NTC!!!
 
So here is an update. I was told today that if i could get on an airplane that I am going to NTC. My PEBLO got in touch with my company CDR and told him the situation. My CDR told him that I would not be going into "the box" at NTC, but I would be in the rear detachment part. My PEBLO then emailed the DCCS and another COL. I was also told that my BDE surgeon signed off on me going which makes this all that much worse. I do not think that it will be considered a lawful order to tell me to get on the plane, and as of right now I am trying to let the system work for me instead of ruffling too many feathers. The OMBUDSMAN is looking like my next best option. Thanks for the replies. Any more info to help my case would be great. I will keep you all updated.
