Non Medical Requirements Decision???

I applied for SSDI in Feb 2015. I received my first profile stating I could not do the job of my AFSC in August 2015 so I said that was the day I ended SGA. I wasn't medically retired from the AF till 29 May 2015 and my most recent letter from Social Security stated that I meet medical requirements but they have not yet made a decision on Non medical requirements because they are saying I ended SGA on 1 June 2015 instead of August 2014. Does this mean I won't get approved because I haven't been out of work long enough? Does anyone have experience?
 
In my case, I stated that my last day of SGA, was the day before I had surgery, then subsequently con-leave. When I came back from con-leave, I no longer performed any MOS duties.

It was approved back dated to the day that I claimed.
 
That's what I put on all my paper work too that the day of my profile was the day I ended SGA. But they didn't take it and changed it to the day I retired. I just don't know what to do now. I think it only effects back pay but I also haven't met the 12 month mark so I'm hoping it doesn't effect my approval. I haven't gotten a lawyer since my case seemed pretty clear cut.
 
You have to wait 5 months from the date they determine you were disabled.
 
5 months will be 1 Nov 2015 so in just a couple weeks. Does that mean I will get approved?
 
It is not so much that you have to wait to be approved but rather the SSA does not pay disability until the sixth month after you have no longer performed SGA. The reason for this is that there are State disability (SDI) benefits that you could be eligible for.
 
If approved, you get paid starting for the 6th month, but the electronic deposit post to your account on the 8th day of the 7th month.

In retrospect, the date each month that an individual receives their Social Security disability payments depend on whether they are receiving Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI).

Please keep in mind that if an individual applied for SSDI benefits on or after May 1, 2011, then they must receive their SSDI payments by direct deposit, or another form of electronic payment. That said, payment dates for SSDI benefits after CY1997 are based on the birthday of the person on whose record the SSDI benefit payment is received. Therefore, if an individual is entitled to Social Security benefits due to a disability, then their own birthday is used to determine their SSDI payment date. As such, in the case of a spouse receiving survivor’s benefits, however, the payment date will be based on the birth date of the deceased individual upon whose work record the benefit payments are based.

To that extent, if the birth date of the person upon whom the SSDI benefits are based falls between the 1st and 10th days of the month, then SSDI benefits will be paid on the second Wednesday of every month. If that birthday falls between the 11th and the 20th, SSDI benefits will be paid on the third Wednesday of every month. And finally, if that birthday falls between the 21st and the 31st of the month, SSDI benefits will be paid on the fourth Wednesday of every month.

In addition, if an individual's SSDI payment date happens to land on a Federal holiday, the Social Security Administration (SSA) will make their SSDI payment on the nearest preceding day that is not a Federal holiday.

With that all said, the SSA provides a "Schedule of Social Security Benefit Payments" calendar (e.g., SSA Publication No. 05-10031) showing dates which individuals receiving Social Security benefits can access online at the following URL https://www.socialsecurity.gov/pubs/calendar.htm.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

My birthday falls on the 16th of the month and my SSDI payment is in the third of every month.

I don't get paid on my birthday, but its close. Interesting that it varies. That would make sense with check printing, but with electronic transfer - not so much.

I didn't get a lawyer either because I thought my case was VERY clear cut. When I applied, in addition to the required documentation, I sent my NMA, which stated my ability to work in any capacity was impacted 100%, LIMDU profiles, records from the hospital I have had to be taken by ambulance to because of my condition, and other relevant documents. I still was denied.
Even my attorney I hired after being denied on appeal is baffled that I wasn't approved. I would look for an attorney in your area the is familiar with wounded warrior cases. It never hurts to talk to one and you will be one step ahead if you are denied. If you are in the DC area or have an issue finding one PM me. The attorney representing me is very knowledgeable and is an Army veteran himself.
