No DA199! Am I typical or atypical?

I'm USAR in IDES since Aug 2012.

I received my VA ratings from the Seattle office March 22, 2013. My PEBLO at Fort Knox said she didnt receive them (odd) so I forwarded to her. PEBLO said the DA199 should be headed my way soon...................

A month 1/2 later still no DA199. I was told to be patient.

Be patient, Fight, Complain---any thoughts?

Welcome to the PEB Forum! :)

As referenced in my signature comments while within the DoD IDES MEB/PEB process, I waited 2.5 months (73 days) for receipt of my error-filled IPEB findings (i.e., DA Form 199 and DoVA supporting disability compensation documentation).

With that said, I shall suggest that you select the "be patient" course of action. To that extent, please remain positively proactive and stay the course throughout your DoD IDES MEB/PEB process interactions to secure the best solution(s) for yourself and your loved ones.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Best Wishes!

Thanks much!

Your PEBLO needs to contact the PEB...just to verify that they have received your ratings. Are you pleased with the ratings?

She said she did that and asked me to be patient. Am I pleased? No. pending receipt of DA199 I am gathering new evidence and preparing my reconsideration or appeal. I hope and pray the DA199 will surprise me in a good way, but I've seen numerous threads on this subject and it's not looking good.....

Well...your ratings won't be different than what the VA has sent you and proposed (at least on the 199). What are your unfitting conditions?

L4, L5, S1 DDD and L5 (left) radiculopathy. I was 40% [VA] on DDD for over 12 years until my "Army" C&P, then they dropped me down to 10%. So today I stand at 10% DDD, 10% Radiculopathy----20% total [VA 90% total].

What is your ROM from that c&p exam? Mainly the forward flexion.. That is what they base their ratings on.

ALL previous C&Ps (last 12 years) involving my ROM were <30 (Forward Flexion), and the trained tech used a Goinometer as their primary tool each time. My Army C&P was a 15-20min Q&A, with no ROM test no trained tech, just a Dr. with calibrated eyeballs I guess----he said my forward flexion was 90 degrees (more than laughable), thus the drop from 40% to 10%. I emailed my PEBLO immediately after the C&P and said it was a sham; she said "you can always appeal". I had two independant ROMs done last month in prep for an appeal. One was done by my SHOCKED VA physical therapist, becasue she has worked with me for 15 years and has done prior C&Ps on me. Anyway, her finished ROM had me at <30 forward flexion and she used a goinometer. I then went to a private hospital and asked for a complete evaluatuion to include a ROM using a goinometer. The result; <30 forward flexion. Each one would get me a rating on 40%. I am still waiting on my DA199 to fire off my appeal.
