unfortunately, I was"discharged to the Retired Reserve" with no opportunity to get MEB. I am waiting on the ABCMR to make a decision as to what should happen to me...for me...as far as a legitimate retirement. 18 years 9 months E7. Injuries incurred in Iraq made me unfit for retention.
 
Wow that is a long process for you. Did they put you on Title 10 orders at least or are you AGR?

Nope I'm just M-day. The Louisiana national guard just likes to take it's time. The Guard is not the most efficient.

My ETS is in November this year and I'm not getting out till this process is complete.
 
I was OIF2, I transfered units about 3 months after getting back. The new unit never mobilized, so I dont think they knew what or how to treat me?????
 
Yeah the bad thing about transferring units is you get a clueless one.
 
thats what happened. So now i await ABCMR and the decision.............
 
Descision was made by ABCMR to bring me back in guard to do LOD,....It was approved 25 july 13. My meb packet has been sent to Pinellas park as of 27 August 13. I had to sign an extension so I would have at least a year on the books to do this.
 
Packet validated at Pinnellas Park and sent to MEB at Ft. Bliss. I had my initial interview with PEBLO today.
 
Case closed on eBenefits today after 6 months at VA for ratings. Waiting on snail mail now. Fingers crossed. :)

PTSD 70%
TBI 40%
Tinnitus 10%
Back 10%
Hand10%
Knee 10%
Finger 10%
Nerve 10%

Praying for PDRL My crash was 3.5 years ago. I have no idea what impact that will have on PDRL. Also not sure if TBI counts for cognitive on my unfits.

Congratulations on receipt of DoVA proposed ratings; your IPEB findings inclusive of DoD and DoVA proposed ratings are forthcoming for sure! :)

Indeed, PDRL with a PTSD medical condition is probable as witnessed and reported by at least 7 PEB Forum members from my last count to date. Otherwise, if your DoVA rating was evaluated under the 38 CFR 4.129 criteria, then most likely the PEB adjudication shall result in a TDRL finding unless you have other conditions that are also unfitting, stable, and combine to rate at 80%.

Thanks for your reply Warrior. The verbiage on my VA finding is straight out of 38 CFR 4.130 for 70% for PTSD. Cognitive NOS was also 70%. Both were unfitting. They could only use one due to not paying twice for the same conditions. They used PTSD.

I see no ref to 38 CFR 4.130 but how would I know if it was used? Thanks!
 
So how long after packet gets back to PEB before they shoot out the rating do you suppose?
 
National Captial Region Physical Evaluation Board sent your case back to VA for reconsideration as of 23 Oct 2013. Waiting to hear something from VA. OK but I didn't ask for reconsideration?

Well, since you have not received your IPEB findings yet, there isn't any official nor unofficial method to determine exactly what finding the PEB shall adjudicate at this time in my opinion.

Indeed, for DoVA D-RAS rating purposes, the 38 CFR 4.130 criteria was used doing their evaluation of your DoD IDES case file's PEB-referred unfitting conditions for PTSD and Cognitive NOS symptomatology.

To that extent, it seems that the norm is for the PEB to adjudicate PTSD under the 38 CFR 4.129 criteria albeit, I don't know exactly for sure since there have been exceptions as I mentioned in a previous post within this thread.

Unfortunately, you will have to wait for the IPEB findings. As such, you may just be pleasantly surprised of the PEB's disability retirement list determination upon receipt!

Just got the permanent profile, 221411, took 2 days after the Doc's at the MTF in Drum saw the packet, being sent straight to an MEB. I will update as warranted.
 
Telcon with PEBLO on the 6th of FEB.... honestly not getting the best of feelings, seemed like I knew more than the PEBLO on somethings
