I am at the 14 month mark without a word from the ABCMR I sent an email requesting a status around month 6 and was told cases are taking 12 months to complete and that was the last thing that I had heard. Fast forward to a month ago I sent an email inquiring on the status of my case and was told cases are now taking 18-24 month OR MORE!!!!! Has anyone received emails back from inquiries or has anyone been told that time frame? Has anyone had the "personality disorder" to medical retirement finished sooner than that recently? any input would be greatly appreciated.

24+- months has been the norm.

We understand your frustration and I can assure you that it is not our intention to disrespect you or any of the other over 23,000 service members that are seeking relief through this agency. In fact, it is quite the opposite. We have had a huge increase in applications, which have become more complicated and now require additional reviews. Additionally, we have undergone downsizing, furloughs and sequestrations, which have resulted in a huge loss in personnel. These are not excuses, merely the reality that is our processing. Each case is given a thorough review before the case is presented to the Board and this process takes a long time to complete. Your case is being processed as quickly as possible but I cannot give you an exact date for completion.

That was my current email from the BCMR today. I'm at 850 days and still counting. So there are cases taking well over the 24 month mark.

I’ve been told 12-24 months then as of like 8 months ago an average of 800 days for adjudication. My case is been sitting there for 794 days according to them but I’m positive it’s been there longer. This has my anxiety high as I’m hoping for justice and a favorable decision. As of last week they stated they hired 40 additional personnel on top of the 20 they hired earlier in the year.

This subject touches on questions from many members. What I'd like to understand is: What options does the Veteran have when the Government doesn't meet the statutory time limits? The requirement is 90% of all cases resolved in 10 months and 18 months for 100% of cases.

Taking the Government to court for breach of the law, although in my pedestrian opinion, would likely result in a favorable judgement wouldn't fix the problem and may make it worse due to resource consumption defending said lawsuit. On the Other Hand, saying/doing nothing isn't helpful and may in-fact be the "greater evil".

Here, the poster is being told that a Government Agency has decided for it's convenience to add additional processes despite the law's requirements. Clearly, personnel should have been added before their new review guidelines and processes went into effect; instead they put the cart before the horse. In fact, due to budget losses they had to layoff personnel despite the increased workload.

If anyone has any ideas, I'm open for pitching in for the greater good.

At day 804/806 I requested another email update to which I’ve finally got a movement in my case; while it was progress it was stated that my case was forwarded to a 3rd party agency for a medical advisory. While that sounded great I was also told that that agency is also backlogged to check back in 60 days. So while I sit here in limbo at the mercy of the ABCMR my faith in the system is growing ever more skeptical to say the least. I won’t be told whom the 3rd party entity is so so much for transparency.

Any idea the timeline from the preliminary opinion? I was hoping that this means they've gone through all of the evidence. I added my response and supposedly it's on the way to the board.

BTW, the response was negative. The reviewer even provided evidence that she was materially wrong and didn't understand the VASRD. She tried to throw out the whole thing by saying that the VA claim was done after discharge/retirement. I've never had more than one VA claim, which was done for the MEB. Not sure why it took her 8 months to be so wrong. Obviously, she didn't even read the lawyer's brief or even the summary.

I am VA P&T as of 2015 but on September 24, 2022 will be 10 year mark and would request any information on required timeline for completion of MEB because due to being denied MEDCOM orders then they messed up any kind of INCAP assistance.

everybody blamed the other wing commander blamed medical for deleting profile from somewhere so he denied me orders and INCAP.

spouse retired 23 yrs 82ND AIRBORNE Ft. Bragg NC with no job so they ended my orders even with a medical plan already started.

so lived wpith friends and family until spouse was hired through DOD civilian contracted and then my VA was approved in OCT 2015.

since then have had both shoulder rotary cuff repair, three back surgeries that did not work so am completely dependent on cane in my home but walker everywhere else.

Have seen military Doctors twice now because anything over 6 months is worthless to MED Board.

Dealing with civilian PEBLO seems like forever and all she does is message or call telling me it was kicked back AGAIN and if I have any documentation I can send to clarify.

know they have NARSUM that finally was given a lawyer and he stated under the condition rule I could add my back from my US Army three year contract I completed and was given 20% through VA

Then got back into shap and joined USAFR next to spouses base it was Pope AFB but budget cuts was deactivated and turned over to the US Army.

stopped VA benefit even though they stated I did not have to but felt wrong since I was completely better.

served in OIF 2009 and OEF 2012-2013

came hometown base and applied for MTI at Lackland AFB Texas and was application was approved.

while doing PT felt a tear in my shoulder and was told complete tear so needed to return to my base and file LOD.

Started physical therapy and seeing army doctor so I had already had medical plan in place but wing commander denied my request then medical started messing up my file deleting profiles that made me ineligible for INCAPACITATED PAY they had a DAWG meeting without letting me sit in or contribute to the meeting.

Right then I new my unit my wing commander and my unit medical unit were NOT going to do right by this airman and was in so much pain I just gave up came back to Oklahoma we’re we were homeless for a while until spouse got work. Even message my unit and they gave me the number for some kind of military food pantry and stated to go onto one source and see if they had grants or Finacial assistance.

i was so upset and could not believe after serving my wing commander unit following regulations and policies they just stopped and went on with unit Business.

put in AFBCMR but was denied because I did not go through every channel to get resolution so put in IG COMPLAINT that was denied and told in writing to try filing AFBCMR.

i am on so many medications for my ptsd and in pain continually so take pain medication and know am being told I maybe getting onset of dementia or Alzheimer’s so may lose my marbles before I get anything completed.

protien in my blood so might also have a bone eating cancer.

Medical doctor sending me for MRI(w/contrast)brain scan to see if I may have tumors or parts of my brain has changed.

Just waiting for the final nail in my coffin but want this resolved so my spouse will get something anything before I meet my maker.

So ANYBODY with a AFI POLICY PLEASE MESSAGE OR POSTE SO MY SPOUSE CAN HELP ME TO SEE IF I HAVE STANDING TO FILE ANOTHER AFBCMR SO I CAN APPLY FOR MY POINTS AND PAY THAT WAS TAKEN WHEN THEY DX ME ON SEPTEMBER 24, 2013.

Thank you for reading and helping incase you know I forget! sorry bad joke but if not get scared thinking about what’s coming!
