Need help with PDBR

Here is my situation...... I was medically boarded out the Army April 2002 at 20% for diabetes metillus received severance pay. The VA rated me at 20%. So now in Sept 2010 I was finally rated 100% combined with secondary conditions with my diabetes. My question is am I eligible for this and if so if they approved me how will they work things out? Will I get any pay? If so will I have to pay it back? If anyone know something I'm all ears. Thanks in advance.
 
Honestly I do not think you could win the case mainly because in 2002 the V.A. agreed so everyone was in agreement at time of separation.

Thanks for your response. I know this PDBR is a crap shoot for some veterans but I was rated 100% in Feb. 2010. I received my packet from the VA in Sept. of 2010 so that when it was retroactive.

I hate to say this, but I have agree with the others. The Board looks at what your VA rating was within 12 months of separation. If your VA rating is/was 30% or higher you would be awarded disability retirement from the branch in which you served. Please submit your request to the board and keep us abreast on the status. To GP007, when you say they look at the VA rating within 12 months of seperation does that include percentages awarded past that time period that was retro'd back past the 12 months of separation?

For example I was medically separated for Asthma at 10%. When I filed for VA compensation I received a 30% rating for Asthma by the VA. But I received a total Va rating of 90% when other connected service disabilities were factored in... Being that I separated Oct 2002 the only VA ratings the board would consider was within a 12 month time frame. So the board only looked from Oct 2002 to Sep 2003 to make their decision to retire me.

I was qualified disability retirement but any of us that are awarded retirement and did not serve 20 years will not receive retroactive pay... Perhaps is they are combat related but I am uncertain. But please file I just wanted you to know. I was disappointed today and I found that not anyone on this board but two people posted on not receiving their retro active pay....

But file and stay one top of it during the entire process. Good luck to you :)

I was asking because it took 8 years for the VA to settle my case. During that 8 year time period several decisions were made and each time the retro'd the date back to date of discharge. To me considering it was all retro'd back it would fall within the timeline of decisions made during the 12 months past enlistment. Unless there is something I am missing.

That is awesome! You stated, "the Army April 2002 at 20% for diabetes metillus" but did the VA put your retroactive rating date to somewhere between April 2002 to April 2003? If so you have a total case and would qualify especially at 100% for that disability. But I think you mentioned the VA rated you for the secondary disability correct? It is my understanding, if the secondary disability was not considered at the time of your separation board the board will not consider it.

I say that because I was separated for Asthma and the AF gave me 10% but the VA gave 30%. So on June 2012 I was award 30% and disability retirement by the Air Force. But on my paperwork from my separation I had other factors listed and AF rated me 0 for both, but VA gave me 10% and 60% for the other two! The Board never looked at the 60% at all and it was as secondary condition to Asthma! They still rated me 30% , 0, 0 when va within 12 months was 30, 10, 60. Just a thought! My total VA rating is 90%. Disregarding what I have said I would definitely give it a try :) it seems some veterans are having better luck than others. I pray you get 100% you deserve it in my book. In each successive rating decision was new evidence considered, or did they find errors in the previous decisions based only on the initially submitted evidence? I am with you that it should not matter since it was all retro'd back to the day after discharge, but I can see how the BCNR could potentially use the long VA decision-making timeline against you by saying something like, "well, your first decision was 0% and the next decision was based on evidence that wasn't submitted until 3 years later, blah blah blah."
