NARSUM only lists 1 condition as chief complaint, when i believe it should be more

Ok, I met with the MEB processor and my PEBLO, and they did my initial (rough draft) NARSUM, on there it only lists Cervicalgia (c-spine) as my chief complaint. In other words this is what I am being boarded for and as it was explained to me is that this is the 1 and only condition that will determine if I am fit or unfit for duty, as well the only condition I will get counted toward a percentage on my disability for retirement purposes. And then was told all my other conditions, i thought to also be service disabling will be the VA percetage. In addition my PEBLO also stated they can only have items in the chief complain or the primary reason to determine if I am fit or unfit I had to be on profile for in the last year. I hope all that made sense, but I have been on profile for my Neck c6-c7 fusion with radiculopathy, as well as Lumbago, with radiculopathy to both of my legs......

But they have these just listed as other diagnoses as they have stated they are not service disabling, but i disagree as my forward flexion on my lumbar spine is only 35 degrees.

Any help on this or comments as how i need to proceed, or does anyone know where it states why they only list cervicalgia would be great.

THanks again to Jason and everyone for the support of this site, so far it is the only thing keeping me from going crazy

Corey,

as far as I interpret your description of facts I would say that sadly, they are right. If your other condition don't call for a "3" on your profile, you will only be rated for them with the VA.
I am not an authority of any kind in this matter though, but my husband had a similar "issue". I can only suggest that you talk to a lawyer before signing anything to make sure that there isn't anything you could do to change things around.

Good luck with your MEB/PEB. Don't lose faith, I know how frustrating, scary and annoying the whole process is.

You need to request an independent review (very important to win an appeal) an address these items. The regs state that all issues are to be listed but I could not get them on and I failed to have an independent review done. I managed to save myself because I wrote a statement identifying the shortfalls in my case, don't count on this as saving you. Independent Review!
