C4-C5 and C5-C6 cervical fusion surgery 6 Jan 11
MEB started 20 DEC 11
C&P 25 Jan 12
NARSUM 31 Jan 12
MEB Packet sent to DC 8 Feb 12(P3 profile given same day)
Received in DC 9 Feb 12
IPEB found unfit 23 Feb 12(e-mail to me by PEBLO on 28 Feb)
VA Rating done 15 March 12 (who knows when the Army really got it but it was given to me June 26)
DD 199 with 10% DoD and 70% VA 26 Jun 12
6 July demand formal and non-concur with PEB findings
24 July 12 Formal Board memo was sent to PEBLO and I signed acknowledgment same day
7 AUG PEB JAG notified me that she would be representig me for FPEB
FPEB 17 Aug 12( fit for duty - Reason P3 was not given until Feb 2012. The nuerosugeon recommended a P2 but was a civilian doctor so my PCM Doc had to put it in the Army e-profile for me. I used a P2 for almost a year, which showed I was fit for duty. Plus the board could not figure out why or who recommended me for MEB. My MTF is not the greatest. I was told several times that cervical fusion is automatic MEB but my Chain of Command did not initiate it nor did my PCM Doc. My commander recommended retain. My PCM Doc change 3 times in the last year so maybe that's where the ball got dropped but not my problem now.
BIG 20 here I come. I had 21 yrs 9 months total - 16yrs 9 months active with 5yrs Reserve/NG, so I wanted to be found fit for duty.
If you have cervical fusion your chances of staying in the military is slim and rating for it is usually low from what I've seen here. What gets you the magic 30% is when you add other unfit conditions. PTSD/Anxiety usually rates 30% or above. I got 50% for it but wanted to kept that on the low low so I could be found fit for duty and make it to 20years. My injury was combat related so I want to get the CRDP too but you need that big 20yrs.
I notice that the FPEB board(for IDES in DC) did not have a full copy of your medical records so use that to your advantage( you may know something they don't which may help you in a formal)
If you really want to win your case I would go with a civilian Laywer( just from my experience with my JAG). She basically did what I do when I have to brief a general. Have my staff go over with me the brief with courses of actions then go brief it. I took a week of PTDY and went to DC and did research(research this board) and did a time line of event which the board will ask you to do. By Army Reg(not sure about the other Branches) you get a minimum of 3 days to prep for the board. I spent an 1hour 1/2 with my JAG out of the 4 days prior to the board which was friday morning 07:30. This is just my two cents may not be the same for everyone.
Best of luck to you all with you MEB/PEB. Try to keep your sanity this process will drive you crazy.
