My PEB changed members then made a decision

I am not sure where else to ask about this and my attorney is not happy at all. On Jan 3 2014 I had my PEB hearing to reconsider a condition as failing. I went to the hearing and the board recessed to send my records back to MTF, on Jan 6 the MTF stated no change ( they did not talk to me or anything, and amazingly had this done over the weekend?) but the board gave no response at that time, this was a difficult case as we are adding my anxiety as failing, after my initial MEB exam was done I was raped by some former soldiers from my unit, thus changing my condition, well after 3.5 weeks I was given a decision that stated a change in diagnosis to PTSD was immaterial. Turns out the Presiding officer on the board retired before making a decision, and he was replaced with a new member who did not see me testify. I understand he heard the taping of the session but due to my meds to listen to me I sound very stoic and matter of fact, while watching me tells more of the story. I feel like I just had a jury trial and after it was handed to the jury they changed the members. I have submitted my final appeal and like I said my attorney is mad, they failed to notify her as well, I am just at a loss and so very tired of this process.
 
Get with warrior64 ASAP, your attorney should be able to request a new formal, or at the least build a very solid case for the secratary appeal. and also I am very very sorry about your situation, being let down by strangers is bad enough, being let down by those you should be able to trust the most has to be much worse. I am no superstar counselor, I am not professionally trained in anything except making sure 1's and 0's go where they are supposed to. But I have a sister,mother, 3 female cousins, Wife, 2 daughters, and have helped countless female troops through "ordinary" situations. Just an update, my appeal was sent off and the decision was changing of my board members did not affect the decision and that the decision will stand... I don't even know how to fight it... and I just no longer have the strength, I am not getting retired, just medically discharged, but I do have a good VA rating... I am just so done with the Army and ready to move on....

Well, that was step 1, step 2 is service secretary appeal, and then if you do not win at that level, pop smoke, get out and fight with the court system. i will re state I am not a counselor or expert on much, but in my experience rape/SA are acts of aggression/power, if you fold in on yourself and give up, even if convicted and sentenced away for life, if they end yours, they win, they prove they had the power over you. It is the same with these idiots who do not know what we go through and judge our lives based on little excerpts on paper writen by people who see us for minutes out of a month or year. You have to dig deep and find the will to fight for your power back. There are those of us here who support you.
