I mentioned to my husband that he should not opt out of MEB . He thinks he will gain nothing more from going through MEB but according to what I have read...I believe we could gain something. Would he loose his disability payment going through the board or is that separate. Right now he still drills and drill pay is subtracted from disability pay. His injuries are service connected and he seems to always be in pain. Thank you!
 
He will continue to drill as normal. The MEB process will take some time (1 to 2 years) the TDRL for up to 5 years. He will not lose anything and hopefully he will be rated above 30%. It is a "win-win" situation for medicals benefits over 30%. It is a long process...patience and knowledge is the key. Good luck.
 
My husband decided to go with MEB/PEB . Today is Captain called him and told him that we
Seriously reconsider what we are doing. He is saying that my husband has a chance of losing his 60% VA rating and ending up with nothing. Is this true? Can they take away his rating? He is on a permanent profile in which he can’t do the pt test, he can’t wear the helmet or vest because it is so painful. He lives with 24/7 pain and they can supposedly prove that this is not the case and strip him of his rating and benefits? My husband is seriously considering withdrawing his submission and not go the MEB/PEB. I don’t know what else to say to him? HELP!!!
 
Also, does he have a chance of losing retirement all together if he goes through MEB/PEB?

First off, Thank you and your husband for your service. I am also new member here and kind of a rookie with all of this stuff. From the research that I have done and what I have read from very experienced members on this board. The military and the VA are two separate entities. The military i.e. your husbands chain of command or "captain" have no authority or power to influence let alone take away your husbands VA benefits/ratings. I am sure other more experienced members will chime in and actually give you sources for reference pertaining to this issue. Your husband should in no way be influenced by his chain of command or company and he should fight for every benefit that he is "OWED!" KEEP CHUGGING ALONG and keep your heads up. Is it true that if because my husband in the Army National Guard which is not full-time service but once a month that my husband will still have to wait to get his retirement at 60 even if the MEB's findings are to retire him and he will not retain TriCare eligibility for himself and eligible family members and will not receive pay immediately because he is not full-time active duty.

No. If he is rated 30% or higher from the PEB he will receive pay immediately and maintain Tricare for him and dependents.
 
Would anyone be free to talk to my husband about this whole MEB/PEB. He is confused and feels uneasy about the whole thing, going through the process. Thank you!
 
Question: After my husband submits all paper work required for the MEB, What happens next? Does he continue drilling while he awaits the findings of the MEB? Thank you!
 
I'm in the National Guard and have been in the MEB process over a year. I have not drilled in that time. The key (at least in my state's case) is that when I went to my National Guard Fit for Duty board, the State Surgeon General filled out a findings results form for me and checked a box that said I am to be removed from drilling. If he had not checked this box, I would have continued drilling during the MEB/PEB. I can't recall the form he used, but I have it somewhere in my records. Your husband could possibly get the state surgeon general to retroactively fill our this form for him, marking the "no more drilling box" since he apparently did not do this during the fit for duty board.
 
I found the form concerning non-drilling. When I went through the Fit For Duty board, an Army medical Colonel filled out a DA Form 4700, Medical Record-Supplemental Medical Data, that states: "Soldier does not meet retention standards per the AR 40-501 Chapter 3. Soldier is entitled, if he chooses, to a duty related MEB. Soldier is removed from all military duties effective today's date." I was also given a profile with P3's. As a result, I am still a member of my National Guard unit but have not attended drill for over a year, with the full knowledge of my guard unit, even though I am in the MEB/PEB process. If the DA Form 4700 had been marked "Soldier may continue to do military duties within the limitations of a profile," then I would have continued to attend drills.
 
I too am NG going through this process. I was told once in the MEB preocess I could only drill in attendance of Medical appointements. This was impoertant. Because the SGLI keeps ringing up debt every month you do not drill.
 
OK! I saw this post when I was doing some research.
I have some delimmas with my so called medical discharge.

I am also a former soldier of the CAARNG. While AGR. I was diagnosed with conditions in both knees, suffered back injuries and ended up diagnosed with Asthma while working around a massive amount of dirt at one of my Detachments.

When I left AGR and dropped back down to MDay status I was placed on a deployment list. Went for my AMC Screening and was told that I would not be deployed because they could not regularly care for my injuried in the field and I would receive a letter from the State Surgeons Office to follow up with my Dr.

Well I received the letter to followup with my physician and to have them fill out paper work for the state office. I ended up going to multiple doctor appointments and having to call the lady at the state surgeons office to get extention for each doctor appointment because I was going through referral after refferal with civilian doctors.
This happened in 2006, well February 2007 I called the State Office and Spoke to the lady again whose name is Laura Merjil. After numerous times of talking to her, attempting to send her paperwork that she refused until it was completed. (Each time I offered to send the papers from each doctor, She specifically told me she did not want any paperwork until I was fully complete with the medical then send it as a whole packet.) In Feb 2007 I called her to let her know I was being referred again and asked if she wanted the documents and she told me no, that she wanted it all together when completed. I told her I had another appointment and she looked me up and could not find me so she placed me on hold and came back a couple minutes later telling me that she discharged me in January.

At that point I got mad because I spoke to her in January and she extended me and refused to take any paperwork from me because my medical treatment was not complete. She really messed up when she told me she discharged me for no paperwork. I asked her why would she discharge me for no paperwork when she refused to take it and told me I had to send it completed. At that point she made excuses telling me that she had too many soldiers to deal with and can't keep track of all of them. I politely blew a fuse with her and told her that I had all the paperwork waiting for her to accept it and I did not give a hoot about the other soldiers, this was my military career she screwed up on.

I told her I could send her the paperwork if she would just accept it and at that point she said I could send it and she would see what she could do, I sent her the documents and she never responded to me again, I could never get her on the phone again. I was never OFFICIALLY Notified of being discharged from the Gaurd, I never received orders or an NGB Form 22 in the mail stating I was dicharged. My unit was full of unknowledgeable people regarding this situation so it left me totally screwed.

After talking to an old boss who convinced me to call state again, I did so and got a Lt on the line who told me that she took over after Ms Merjil was relieved of duty. I asked about getting my orders revoked again because I was never medically boarded due to the above situation in which I had told her what happened. She looked me and could not find anything. Not even the documents I sent to the state.

in 2010 I contacted the JAG office and they attempted to contact the state surgeons office to question about my medical discharge and documents. They replied by email that they had no knowledge of my Medical nor my discharge. I went to AKO and looked to see if anything was on my iPerms and found the discharge orders and NGB Form 22 there. So there is documentation of me being discharged medically unfit but they claim to have no knowledge of it. JAG eventually told me they could not help me and told me to contact IG in which they would not help me either because they claim I went past the 2 year time limit.

Yes this is a long situation. I did go to VA and filed for compensation and was determined 30% disabled. I am gonna be going for more soon because my back has gotten worse in the past couple of years.

I contacted NGB IG and told them of the situation and they have yet to respond back. I need to know what to do at this point. I had 8 years left, I was a Supply Sgt and my injuries were not affecting my job. I was never medically boarded although somehow she discharged me medically. She put and RE 3 code on my form to keep from having to rate or compensate me.

At this point what can I do. I would like to get my medical retirement because I deserve at least that.

If anyone knows my options to this Illegal Medical Discharge I would love the information.

I originally posted this thread in another location, I am still gathering information from all of you out there that has had to deal with the National Guard (State NGB) for medical retirement.

I also received another letter from CA ARNG stating that I was granted Separation from the CA ARNG due to medical reasons and was found un-fit for duty. My new ETS date is 24 July 2009, I have not received a letter stating if I will receive a medical Pension or Severance Pay. I am still waiting.
I am going through the same thing but I am totally getting screwed from VA and Peblo an unit. First of all I am told if I am medically retired out I would get retirement . But peblo says I will have to wait til I am sixty to get retirement. I getting paid fifty percent but actually at 60%. I am appealing my ptsd rating because I am at the point where I am suicidal anymore and I feel that thirty percent is a joke. But I really don't have faith in The VA since it has been three years now that I am waiting on a appeal for my knees that are due from the military. I have 26 good years and two tours back to back in Iraq. I received the Bronze Star and combat action badge.
 
I am waiting for peblo to get a date to go to Washington to fight this. I guess they have a lawyer going with me.
 
I'm struggling through this right now. I really want to get this done so I can move on. I'm going through this, a divorce from my SO, selling a house I haven't been in since July that flooded in September, oh and I had a stroke in Dec of 15. I have to make a choice by the 24th of april. I am a fed tech and have 15 years in.
