Our family has been battling this MEB of Degenerative disk with a 10% dishcarge since Sep 2010 and 7 months later it is finally at SAF. I wish to return to duty.

A few questions, Member has 14 years 3 months in. DD is workable don't miss work, treatment plan works, the only issues are PT (no situps). The MEB was forward to IPEB withall consultations to include the range of motion of over 180 days past the 90 days. Now per, AFI 48-123, when members are undergoing an MEB, “Documentation sent to the PEB for adjudication must not be over 90 days old when received at AFPC.” No matter, it still occured and the IPEB concured with the results of 10%.

Therefore, I sent it up to SAF hoping to that they will do the right thing and go by AFI's because for 1, I wasn't even finished with my treatment of epidural shots prior to the package being wrote. However, once the treatment was finished my DR. gave me no healing time as he says that DD is forever and that if I stay in my Career field, pain will come back. Now, I found out so many people are walking around with DD and not on MEBs. So why am I being put on an MEB?

Also, the reason that the consulatations were so old is because the Doc had messed up so bad on the the first NARSUM and I refused to sign it (Dec 2010). He had to redo it. At that point he call me in May 2010, with no new work up but my condition much better (after the treatments) and did not do any new health assesments at all and sent it up with the same information but modified my age and some other relevant information. No matter the ROM test that was sent up was done back in Aug 2010 and I did not start treatment until Sept 2010 (finishing Nov 2010) and they still did not do another ROM test.

No matter, shouldn't I have been given up to date medical status?

Also, once at SAF how long does it take? They said it got there to SAF 3 weeks ago and still no word.

Thanks,
Linda
